{"id":7680,"date":"2023-07-06T16:26:58","date_gmt":"2023-07-06T13:26:58","guid":{"rendered":"https:\/\/www.lugera.ro\/blog\/?p=7680"},"modified":"2023-07-25T13:25:47","modified_gmt":"2023-07-25T10:25:47","slug":"conflictul-de-munca-regulile-sunt-incluse-acum-in-codul-muncii","status":"publish","type":"post","link":"https:\/\/www.lugera.ro\/blog\/conflictul-de-munca-regulile-sunt-incluse-acum-in-codul-muncii\/","title":{"rendered":"Conflictul de Munc\u0103 &#8211; Regulile sunt incluse acum \u00een Codul Muncii"},"content":{"rendered":"<p>Regulile privind conflictele individuale de munc\u0103 \u0219i termenul de apel se g\u0103sesc acum \u00een <a href=\"https:\/\/www.codulmuncii.ro\/homepage.html\" target=\"_blank\" rel=\"noopener\">Codul Muncii<\/a>, \u00een timp ce Legea dialogului social se axeaz\u0103 pe aspectele referitoare la conflictele colective de munc\u0103. \u00cen cazul conflictelor individuale, exist\u0103 posibilitatea ca p\u0103r\u021bile s\u0103 recurg\u0103 la conciliere pentru a-\u0219i solu\u021biona problemele, \u00eens\u0103 angajatul beneficiaz\u0103 de acces ne\u00eengr\u0103dit la justi\u021bie, ceea ce \u00eei permite s\u0103 \u00ee\u0219i caute dreptatea \u00een instan\u021b\u0103 \u00een cazul \u00een care nu se poate ajunge la un acord amiabil.<\/p>\n<p>Conform <a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/262989\" target=\"_blank\" rel=\"noopener\">Legii dialogului social nr. 367\/2022<\/a>, conflictul de munc\u0103 reprezint\u0103 \u201econflictul dintre angaja\u021bi\/ lucr\u0103tori \u0219i angajatori privind interesele cu caracter economic, profesional, social sau alte drepturi rezultate din desf\u0103\u0219urarea raporturilor de munc\u0103 sau de serviciu. Conflictele de munc\u0103 pot fi colective sau individuale\u201d. \u00cen prezent, \u00een legea respectiv\u0103, nu mai reg\u0103sim defini\u021bia conflictului individual, fiind men\u021bionat\u0103 doar cea a conflictului colectiv de munc\u0103. Aceast\u0103 situa\u021bie a impus adoptarea unei ordonan\u021be de Guvern pentru a acoperi lipsurile \u00een privin\u021ba competen\u021bei \u00een materie de conflicte individuale de munc\u0103.<\/p>\n<p>\u00cen Codul Muncii, conflictul de munc\u0103 se define\u0219te ca fiind \u201econflictul dintre salaria\u021bi \u0219i angajatori privind interesele cu caracter economic, profesional sau social ori drepturile rezultate din desf\u0103\u0219urarea raporturilor de munc\u0103\u201d. Cu toate acestea, legea garanteaz\u0103 accesul ne\u00eengr\u0103dit la justi\u021bie pentru salariat, ceea ce \u00eenseamn\u0103 c\u0103 acesta are dreptul s\u0103 \u00ee\u0219i caute dreptatea \u00een instan\u021b\u0103, iar angajatorul nu poate \u00eempiedica acest demers. Codul muncii precizeaz\u0103 c\u0103, \u00een cazul unui conflict individual de munc\u0103, p\u0103r\u021bile trebuie s\u0103 ac\u021bioneze cu bun\u0103-credin\u021b\u0103 \u0219i s\u0103 \u00eencerce s\u0103 solu\u021bioneze problema pe cale amiabil\u0103.<\/p>\n<p>Dac\u0103 \u00eencheierea unui acord amiabil nu este posibil\u0103 sau a avut loc \u0219i a e\u0219uat, salariatul poate alege s\u0103 \u00ee\u0219i caute dreptatea \u00een instan\u021b\u0103. Astfel, \u00een vederea promov\u0103rii solu\u021bion\u0103rii amiabile \u0219i rapide a conflictelor individuale de munc\u0103, contractul individual de munc\u0103 poate con\u021bine o clauz\u0103 prin care p\u0103r\u021bile stabilesc c\u0103 orice conflict va fi solu\u021bionat prin conciliere. Cu toate acestea, \u00een absen\u021ba unui acord pentru conciliere sau dac\u0103 aceasta a e\u0219uat, salariatul poate s\u0103 \u00ee\u0219i caute dreptatea \u00een instan\u021b\u0103.<\/p>\n<p>\u00cen ceea ce prive\u0219te jurisdic\u021bia muncii, cauzele referitoare la conflictele individuale de munc\u0103 \u0219i cele colective sunt solu\u021bionate \u00een prim\u0103 instan\u021b\u0103 de c\u0103tre tribunalul \u00een a c\u0103rui circumscrip\u021bie reclamantul \u00ee\u0219i are domiciliul, re\u0219edin\u021ba sau locul de munc\u0103, sau, dup\u0103 caz, sediul. Aceste cauze sunt scutite de taxa judiciar\u0103 de timbru \u0219i de timbrul judiciar, iar termenele de judecat\u0103 nu pot dep\u0103\u0219i 15 zile.<\/p>\n<p>Potrivit Articolului 268 alineatul (1) din Codul Muncii, cererile pentru solu\u021bionarea unui conflict de munc\u0103 pot fi formulate \u00een diferite termene, \u00een func\u021bie de natura situa\u021biei. Astfel, \u00een termen de 45 de zile calendaristice de la data la care persoana interesat\u0103 a luat cuno\u0219tin\u021b\u0103 de m\u0103sura adoptat\u0103 referitoare la contractul individual de munc\u0103, inclusiv angajamentele de plat\u0103 a unor sume de bani, cererile pot fi depuse.
