Eventualele prejudicii pot fi recuperate doar prin acordul p\u0103r\u021bilor."},"content":{"rendered":"<p style=\"text-align: justify;\">\u00cen urma unei <a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/264629\" target=\"_blank\" rel=\"noopener\">decizii<\/a> privind neconstitu\u021bionalitatea unor prevederi din Ordonan\u021ba privind r\u0103spunderea militarilor, Curtea Constitu\u021bional\u0103 a subliniat importan\u021ba respect\u0103rii principiilor statului de drept \u0219i a securit\u0103\u021bii juridice \u00een raporturile de munc\u0103. Aceast\u0103 decizie a confirmat c\u0103 actualul <a href=\"https:\/\/www.codulmuncii.ro\/homepage.html\" target=\"_blank\" rel=\"noopener\"><strong>Cod al Muncii<\/strong><\/a> nu permite folosirea deciziilor de imputare de c\u0103tre angajatori pentru a efectua re\u021bineri salariale pentru a acoperi eventualele daune produse de angaja\u021bi \u0219i c\u0103, \u00een lipsa acordului angajatului de a acoperi prejudiciul, angajatorul nu poate efectua pur \u0219i simplu re\u021bineri salariale.<\/p>\n<p style=\"text-align: justify;\">\u00cen contextul rela\u021biilor de munc\u0103, r\u0103spunderea patrimonial\u0103 are la baz\u0103 un prejudiciu care poate fi cauzat de angajator sau de angajat. Pentru fiecare situa\u021bie \u00een parte, Codul Muncii stabile\u0219te reguli pentru a asigura echilibrul \u00een rela\u021biile de munc\u0103.<\/p>\n<p style=\"text-align: justify;\">Dac\u0103 un salariat sufer\u0103 un prejudiciu, acesta nu poate impune unilateral angajatorului s\u0103 recupereze sumele respective, la fel cum \u0219i angajatorul nu poate decide unilateral re\u021binerea unor sume din drepturile salariale cuvenite angajatului. \u00cen cazul \u00een care angajatorul constat\u0103 o pagub\u0103, trebuie s\u0103 identifice salariatul responsabil \u0219i s\u0103 evalueze dac\u0103 prejudiciul are leg\u0103tur\u0103 cu munca acestuia \u0219i dac\u0103 salariatul este vinovat.<\/p>\n<p style=\"text-align: justify;\"><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/07\/shutterstock_1220534692.jpg\"><img decoding=\"async\" class=\"alignnone wp-image-7677 size-full lazyload\" data-src=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/07\/shutterstock_1220534692.jpg\" alt=\"Decizia de imputare nu poate fi utilizat\u0103 de angajatori\" width=\"1000\" height=\"667\" data-srcset=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/07\/shutterstock_1220534692.jpg 1000w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/07\/shutterstock_1220534692-300x200.jpg 300w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/07\/shutterstock_1220534692-768x512.jpg 768w\" data-sizes=\"(max-width: 1000px) 100vw, 1000px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 1000px; --smush-placeholder-aspect-ratio: 1000\/667;\" \/><\/a><\/p>\n<p style=\"text-align: justify;\">Numai \u00een aceste situa\u021bii, angajatorul poate solicita salariatului recuperarea pagubei prin acordul p\u0103r\u021bilor, oferindu-i acestuia un termen de cel pu\u021bin 30 de zile pentru achitarea sumelor respective. Totodat\u0103, Codul Muncii a stabilit un nivel maxim al prejudiciului care poate fi recuperat prin acordul p\u0103r\u021bilor, suma fiind limitat\u0103 la contravaloarea a cel mult cinci salarii minime brute pe economie.<\/p>\n<p style=\"text-align: justify;\">Dac\u0103 prejudiciul dep\u0103\u0219e\u0219te acest prag, angajatorul poate recurge la instan\u021bele competente pentru a solu\u021biona conflictul de munc\u0103 printr-o ac\u021biune \u00een r\u0103spundere patrimonial\u0103.<\/p>\n<p style=\"text-align: justify;\">De\u0219i decizia de imputare \u00eenc\u0103 mai apare men\u021bionat\u0103 \u00een unele prevederi legale, acest concept a fost declarat neconstitu\u021bional, iar r\u0103spunderea patrimonial\u0103 \u00een rela\u021biile de munc\u0103 se stabile\u0219te acum prin acordul p\u0103r\u021bilor sau prin hot\u0103r\u00e2re judec\u0103toreasc\u0103, asigur\u00e2nd astfel un echilibru \u00een raporturile de munc\u0103.&nbsp;<\/p>\n<p style=\"text-align: justify;\">\u00cen situa\u021bia \u00een care angajatorul dore\u0219te s\u0103 recupereze prejudiciul \u00een baza unui acord, va \u00eencheia o not\u0103 de constatare \u0219i evaluare, identific\u00e2nd salariatul vinovat \u0219i evalu\u00e2nd suma de recuperat. Salariatul are dreptul de a contesta aceast\u0103 not\u0103 \u0219i de a se adresa instan\u021bei competente \u00een cazul \u00een care nu este de acord cu evaluarea pagubei.<\/p>\n<p style=\"text-align: justify;\">Suma pentru acoperirea daunelor se va re\u021bine, \u00een rate lunare, din drepturile salariale ale salariatului, \u00eens\u0103 <em><strong>ratele nu pot dep\u0103\u0219i o treime din salariul lunar net \u0219i, \u00eempreun\u0103 cu alte eventuale re\u021bineri pe care le-ar avea cel \u00een cauz\u0103, nu pot reprezenta mai mult de jum\u0103tate din salariul acestuia.<\/strong><\/em><\/p>\n<p style=\"text-align: justify;\">\u00cen concluzie, \u00een raporturile de munc\u0103, respectarea principiilor statului de drept \u0219i a legisla\u021biei \u00een vigoare este esen\u021bial\u0103 pentru a asigura un tratament corect \u0219i echitabil at\u00e2t pentru angajatori, c\u00e2t \u0219i pentru angaja\u021bi.
