Ordinul a fost publicat \u00een Monitorul Oficial \u0219i mare parte dintre prevederile sale se aplic\u0103 deja, cu excep\u021bia prevederilor art. I pct. 65 &#8211; 66, care intr\u0103 \u00een vigoare la 30 de zile de la data public\u0103rii acesteia \u00een Monitorul Oficial (respectiv pe 24 iunie).<\/p>\n<p><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/06\/shutterstock_1906238101.jpg\"><img decoding=\"async\" class=\"alignnone size-full wp-image-7661 lazyload\" data-src=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/06\/shutterstock_1906238101.jpg\" alt=\"dialogul social\" width=\"1000\" height=\"667\" data-srcset=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/06\/shutterstock_1906238101.jpg 1000w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/06\/shutterstock_1906238101-300x200.jpg 300w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/06\/shutterstock_1906238101-768x512.jpg 768w\" data-sizes=\"(max-width: 1000px) 100vw, 1000px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 1000px; --smush-placeholder-aspect-ratio: 1000\/667;\" \/><\/a><\/p>\n<p>Principalele modific\u0103ri aduse de ordonan\u021b\u0103 includ:<\/p>\n<ul>\n<li>Extinderea perioadei disponibile pentru angajator pentru <strong>ini\u021bierea negocierii colective<\/strong>, de la 5 zile la 15 zile calendaristice.<\/li>\n<li><strong>Introducerea unor clauze specifice aplicable fiec\u0103rei categorii de IMM-urilor \u00een contractele colective de munc\u0103 \u00eencheiate la nivel de sector sau na\u021bional<\/strong>, pentru a se asigura o protec\u021bie extins\u0103 a capitalul rom\u00e2nesc. Dac\u0103 nu exist\u0103 sau nu se introduc clauze specifice pentru fiecare categorie de IMM-uri \u00een cadrul Contractului Colectiv de Munc\u0103 (CCM) \u00eencheiat la nivel de sector de negociere colectiv\u0103 sau na\u021bional, prevederea se aplic\u0103 \u00een cazul \u00een care exist\u0103 sau se \u00eenfiin\u021beaz\u0103 IMM-uri. \u00cen aceast\u0103 situa\u021bie, IMM-urile respective nu sunt obligate s\u0103 aplice acel CCM \u0219i acesta va fi respins la \u00eenregistrare.<\/li>\n<li>Corelarea prevederilor aplicabile acordurilor colective cu cele ale contractelor colective de munc\u0103.<\/li>\n<li>Participarea unui reprezentant al organiza\u021biilor patronale reprezentative ale IMM-urilor la negocierile pentru contractul colectiv de munc\u0103 la nivel sectorial. Refuzul scris de participare\/semnare nu poate avea ca rezultat ne\u00eenregistrarea CCM-ului.<\/li>\n<li>Se adaug\u0103 o prevedere conform c\u0103reia nulitatea unei clauze din contractul colectiv de munc\u0103 negociat \u00een sistemul bugetar, cu nerespectarea articolelor referitoare la negocierea colectiv\u0103, poate fi solicitat\u0103 de p\u0103r\u021bile interesate, fie prin ac\u021biune, fie prin excep\u021bie, \u0219i poate fi invocat\u0103 de instan\u021b\u0103, din oficiu, pe durata existen\u021bei contractului colectiv de munc\u0103. Constatarea nulit\u0103\u021bii clauzelor contractuale este de competen\u021ba instan\u021belor judec\u0103tore\u0219ti, la solicitarea p\u0103r\u021bii interesate, fie prin ac\u021biune, fie prin excep\u021bie.<\/li>\n<li>Se elimin\u0103 prevederea conform c\u0103reia, \u00een absen\u021ba unui contract colectiv de munc\u0103 \u00een vigoare, conflictul colectiv de munc\u0103 poate viza revendic\u0103ri ale angaja\u021bilor\/lucr\u0103torilor privind ap\u0103rarea intereselor colective cu caracter economic, profesional sau social, deoarece aceasta con\u021bine o interdic\u021bie general\u0103 privind declan\u0219area grevei pe durata contractului colectiv de munc\u0103.<\/li>\n<li>Permite oric\u0103rei organiza\u021bii sindicale s\u0103 declan\u0219eze un conflict colectiv de munc\u0103.<\/li>\n<li>Schimbarea cadrului legal pentru stabilirea sectoarelor de negociere colectiv\u0103 \u0219i a codurilor aferente prin ordin al ministrului muncii \u0219i solidarit\u0103\u021bii sociale. Cadru legal pentru stabilirea sectoarelor de negociere colectiv\u0103 \u0219i a codurilor aferente acestora urmeaz\u0103 s\u0103 fie stabilit prin ordin emis de c\u0103tre ministrul Muncii \u0219i Solidarit\u0103\u021bii Sociale, \u00een loc de hot\u0103r\u00e2re de Guvern, a\u0219a cum este \u00een prezent. \u00cen proiectul de Ordonan\u021b\u0103 de Urgen\u021b\u0103, autorit\u0103\u021bile ministeriale au men\u021bionat c\u0103 Hot\u0103r\u00e2rea de Guvern nr. 171\/2023 (care reglementeaz\u0103 sectoarele de negociere colectiv\u0103 actuale) va fi abrogat\u0103 \u00een termen de 6 luni de la intrarea \u00een vigoare a ordonan\u021bei respective. Aceast\u0103 modificare a actului prin care se stabilesc sectoarele este justificat\u0103 de dorin\u021ba de a asigura flexibilitate \u00een procedura de revizuire a sectoarelor de negociere colectiv\u0103.<\/li>\n<li>Definirea \u0219i modificarea unor termeni referitori la organiza\u021biile sindicale \u0219i patronate, precum \u0219i corectarea unor erori materiale din lege. Asftel se redefinesc termeni precum \u201eorganiza\u021bie sindical\u0103\u201d, \u201edepozitar al contractului\/ acordului colectiv de munc\u0103\u201d, \u201esector de negociere colectiv\u0103\u201d \u0219.a., sunt aduse multiple modific\u0103ri la constituirea \u0219i organizarea sindicatelor \u0219i patronatelor \u0219i&nbsp;sunt corectate, prin proiectul de OUG, mai multe erori materiale din cuprinsul noii legi;<\/li>\n<li>Suspendarea contractului individual de munc\u0103 sau a raportului de serviciu pe durata particip\u0103rii la grev\u0103 la ini\u021biativa angajatului.<\/li>\n<li>Impunerea de amenzi pentru ingerin\u021bele angajatorilor sau autorit\u0103\u021bilor publice \u00een constituirea organiza\u021biilor sindicale sau \u00een exercitarea drepturilor acestora. Astfel, orice interven\u021bie a angajatorilor, patronilor sau a organiza\u021biilor patronale, fie direct, fie prin reprezentan\u021bii sau membrii lor, \u00een procesul de constituire al organiza\u021biilor sindicale sau \u00een exercitarea drepturilor acestora va atrage aplicarea unei amenzi \u00een cuantum de 20.000 &#8211; 25.000 de lei.<\/li>\n<li>De asemenea, orice interferen\u021b\u0103 din partea autorit\u0103\u021bilor publice, a angajatorilor \u0219i a organiza\u021biilor acestora \u00een procesul de selectare a reprezentan\u021bilor angaja\u021bilor\/lucr\u0103torilor sau \u00een obstruc\u021bionarea desf\u0103\u0219ur\u0103rii acestor alegeri va fi sanc\u021bionat\u0103 cu o amend\u0103 cuprins\u0103 \u00eentre 30.000 \u0219i 50.000 de lei.<\/li>\n<\/ul>\n<p>\u00cen ceea ce prive\u0219te Codul muncii, ordonan\u021ba prevede <strong><em>plata zilelor de concediu de \u00eengrijitor<\/em><\/strong>, <strong><em>modificarea obligativit\u0103\u021bii negocierii colective pentru angajatorii cu cel pu\u021bin 10 angaja\u021bi \u0219i corelarea acesteia cu noua lege a dialogului social<\/em><\/strong> \u0219i stabile\u0219te <strong><em>competen\u021ba tribunalului pentru judecarea conflictelor individuale \u0219i colective de munc\u0103<\/em><\/strong>, precum \u0219i a unui <strong><em>apel de 10 zile de la data comunic\u0103rii<\/em><\/strong>. De asemenea, exist\u0103 o prevedere conform c\u0103reia litigiile aflate \u00een curs de judecat\u0103 la data intr\u0103rii \u00een vigoare a ordonan\u021bei (25 mai) vor fi solu\u021bionate de c\u0103tre instan\u021bele competente la data la care au fost sesizate.
