Cu toate acestea, apari\u021bia acestui nou tip de suspendare poate genera unele provoc\u0103ri \u0219i probleme practice pentru angajatori.<\/p>\n<h2><strong>Suspendarea CIM &#8211; Determinarea perioadei \u00een care CIM est supendat<\/strong><\/h2>\n<p>Deoarece legea nu stabile\u0219te o perioad\u0103 maxim\u0103 de suspendare \u00een aceste cazuri, angajatorii se pot confrunta cu dificult\u0103\u021bi \u00een determinarea clar\u0103 a perioadei \u00een care contractul de munc\u0103 este suspendat, fapt care poate afecta organizarea intern\u0103 a activit\u0103\u021bii \u0219i capacitatea de a g\u0103si un \u00eenlocuitor pentru perioada de suspendare, care poate fi greu de anticipat.<\/p>\n<p>\u00cen sita\u021bia asistentului maternal, spre exemplu, activitatea este reglementat\u0103 prin <a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/156097\">Legea nr. 272\/2004<\/a> privind protec\u021bia \u0219i promovarea drepturilor copilului \u0219i prin <a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/44582\">Hot\u0103r\u00e2rea Guvernului nr. 679\/2003<\/a> privind condi\u021biile de ob\u021binere a atestatului, procedurile de atestare \u0219i statutul asistentului maternal profesionist. Conform prevederilor acestor acte normative, contractul individual de munc\u0103 al asistentului maternal este \u00eencheiat pe perioada de valabilitate a atestatului. Astfel, \u00een cazul asistentului maternal, contractul individual de munc\u0103 poate r\u0103m\u00e2ne suspendat pe toat\u0103 perioada c\u00e2t acesta de\u021bine un atestat \u0219i are \u00eencheiat un contract individual de munc\u0103 pentru asistent maternal, f\u0103r\u0103 o limitare \u00een timp. Aceasta poate crea incertitudine \u0219i dificult\u0103\u021bi \u00een ceea ce prive\u0219te planificarea activit\u0103\u021bii \u0219i substituirea asistentului maternal \u00een aceast\u0103 perioad\u0103 prelungit\u0103.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00cen plus, exist\u0103 unele neclarit\u0103\u021bi cu privire la aplicarea prevederilor <a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/270741\">Legii 140\/2023<\/a> \u00een cazul asisten\u021bilor maternali. Cu toate acestea, anumite drepturi \u0219i obliga\u021bii ale p\u0103r\u021bilor pot fi \u00een continuare valabile \u0219i pe durata suspend\u0103rii. Spre exemplu, salariatul este \u00een continuare obligat s\u0103 respecte confiden\u021bialitatea \u0219i s\u0103 fie fidel angajatorului. De asemenea, angajatorul poate fi obligat s\u0103 acorde salaria\u021bilor anumite drepturi care nu constituie o contrapresta\u021bie direct\u0103 pentru munca prestat\u0103, cum ar fi asigurarea unei locuin\u021be de serviciu sau plata chiriei ca beneficiu extrasalarial.<\/p>\n<p>Totodat\u0103, \u00een cazul suspend\u0103rii contractului individual de munc\u0103, se suspend\u0103 toate termenele care au leg\u0103tur\u0103 cu \u00eencheierea, modificarea, executarea sau \u00eencetarea contractului individual de munc\u0103, cu excep\u021bia situa\u021biilor \u00een care contractul individual de munc\u0103 \u00eenceteaz\u0103 de drept. Dac\u0103 angajatorul vizeaz\u0103, spre exemplu, desfiin\u021barea postului ocupat de salariatul av\u00e2nd contractul individual de munc\u0103 suspendat, acest lucru nu se va putea realiza dec\u00e2t dup\u0103 \u00eencetarea cazului de suspendare.<\/p>\n<p>\u00cen concluzie, introducerea acestui nou tip de suspendare a CIM aduce cu sine anumite probleme practice pentru angajatori.
