Potrivit legisla\u021biei \u00een vigoare, \u00een primele opt s\u0103pt\u0103m\u00e2ni de la na\u0219tere, ta\u021bii au posibilitatea de a beneficia de 10 sau 15 zile lucr\u0103toare de concediu paternal, cu o indemniza\u021bie echivalent\u0103 cu salariul pe perioada respectiv\u0103. \u00cen situa\u021bia \u00een care un angajat de\u021bine mai multe contracte de munc\u0103, acesta poate solicita concediul paternal doar la unul dintre angajatori.<\/p>\n<h2><strong>Durata standard a concediului paternal <\/strong><\/h2>\n<p>Conform prevederilor Codului Muncii \u0219i ale Legii nr. 210\/1999, durata standard a concediului paternal este de 10 zile lucr\u0103toare, dar ta\u021bii care au absolvit un curs de \u00eengrijire a nou-n\u0103scutului beneficiaz\u0103 de un concediu de 15 zile lucr\u0103toare. Angajatorii nu au dreptul de a refuza acordarea concediului paternal, \u00eens\u0103 solicitarea acestuia trebuie f\u0103cut\u0103 de c\u0103tre angajat, indic\u00e2nd perioada dorit\u0103 de 10 sau 15 zile lucr\u0103toare.<\/p>\n<h2><strong>Pe durata concediului paternal contractul de munc\u0103 este suspendat la ini\u021biativa angajatului<\/strong><\/h2>\n<p>Pe durata concediului paternal contractul de munc\u0103 este suspendat la ini\u021biativa salariatului, conform Codului Muncii. \u00cen aceast\u0103 perioad\u0103, angajatul are dreptul la o indemniza\u021bie suportat\u0103 integral de angajator, care include salariul pe perioada concediului, precum \u0219i sporurile \u0219i adaosurile la salariul de baz\u0103, conform normelor de aplicare ale Legii 210. \u00cen cazul angaja\u021bilor din sectorul public, exist\u0103 reglement\u0103ri speciale.<\/p>\n<h2><strong>Solicitarea concediului paternal \u00een cazul angaja\u021bilor cu mai multe contracte<\/strong><\/h2>\n<p>\u00cen ceea ce prive\u0219te un angajat cu mai multe contracte de munc\u0103, legea nu precizeaz\u0103 \u00een mod explicit necesitatea solicit\u0103rii concediului paternal la fiecare angajator. Totu\u0219i, din perspectiva logicii acord\u0103rii concediului, ar fi de a\u0219teptat ca angajatul s\u0103 intre \u00een concediu la fiecare dintre angajatorii s\u0103i, \u00eentruc\u00e2t principalul scop al acestui drept conferit de lege este s\u0103 permit\u0103 tat\u0103lui s\u0103 petreac\u0103 timp al\u0103turi de copilul nou-n\u0103scut. Prin urmare, nu ar fi justificat\u0103 intrarea \u00een concediu doar la unul dintre angajatori.<\/p>\n<h2><strong>Angajatul poate continua s\u0103 desf\u0103\u0219oare activitatea \u0219i \u00een timpul concediului paternal la unii dintre angajatori<\/strong><\/h2>\n<p>Exist\u0103 situa\u021bii \u00een care angajatul poate solicita concediul paternal doar la unul dintre angajatori, continu\u00e2nd activitatea la cel\u0103lalt. Aceasta poate fi determinat\u0103 de specificul fiec\u0103rui contract de munc\u0103. De exemplu, unul dintre contracte poate fi de telemunc\u0103, permi\u021b\u00e2nd angajatului s\u0103 lucreze de acas\u0103 \u00een timpul concediului paternal, \u00een timp ce cel\u0103lalt contract poate implica deplas\u0103ri din domiciliu.
