Negocierea este un proces care implic\u0103 p\u0103r\u021bile interesate \u00een stabilirea clauzelor \u0219i condi\u021biilor contractuale.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Nu exist\u0103 un model-cadru universal pentru CCM<\/strong><\/h2>\n<p style=\"text-align: justify;\">Spre deosebire de contractele individuale de munc\u0103, care au un model-cadru standard, CCM-urile nu au un format prestabilit. Acestea pot varia \u00een func\u021bie de specificul unit\u0103\u021bii, grupului de unit\u0103\u021bi sau chiar la nivel sectorial sau na\u021bional. Fiecare CCM este rezultatul negocierilor dintre p\u0103r\u021bi \u0219i reflect\u0103 particularit\u0103\u021bile \u0219i nevoile acestora.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Variantele de participare la negocierile colective<\/strong><\/h2>\n<p><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/06\/shutterstock_2260478119.jpg\"><img decoding=\"async\" class=\"wp-image-7644 size-full lazyload\" data-src=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/06\/shutterstock_2260478119.jpg\" alt=\"CCM Variantele de participare la negocierile colective\" width=\"1000\" height=\"585\" data-srcset=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/06\/shutterstock_2260478119.jpg 1000w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/06\/shutterstock_2260478119-300x176.jpg 300w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/06\/shutterstock_2260478119-768x449.jpg 768w\" data-sizes=\"(max-width: 1000px) 100vw, 1000px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 1000px; --smush-placeholder-aspect-ratio: 1000\/585;\" \/><\/a><\/p>\n<p style=\"text-align: justify;\">Legea dialogului social prevede cinci variante prin care salaria\u021bii pot participa la negocierile colective, iar acestea trebuie prezentate \u00een mod corect \u0219i transparent de c\u0103tre angajator. Ordinea acestor variante este stabilit\u0103 de lege \u0219i include:<\/p>\n<p style=\"text-align: justify;\">(1) sindicatul reprezentativ la nivel de unitate, respectiv cel al c\u0103rui num\u0103r de membri reprezint\u0103 cel pu\u021bin 35% din num\u0103rul total de angaja\u021bi\/lucr\u0103tori afla\u021bi \u00eentr-un raport juridic de munc\u0103 sau un raport de serviciu cu unitatea \u0219i acest aspect a fost constatat de instan\u021ba competent\u0103<\/p>\n<p style=\"text-align: justify;\">(2) federa\u021biile sindicale reprezentative la nivelul sectorului de negociere colectiv\u0103, la solicitarea \u0219i \u00een baza mandatului sindicatelor nereprezentative din unitate afiliate acestora,<\/p>\n<p style=\"text-align: justify;\">(3) federa\u021biile sindicale nereprezentative din sectorul de negociere colectiv\u0103 membre ale confedera\u021biilor reprezentative la nivel na\u021bional, la solicitarea \u0219i \u00een baza mandatului sindicatelor nereprezentative din unitate afiliate acestora,<\/p>\n<p style=\"text-align: justify;\">(4) toate sindicatele nereprezentative din unitate \u0219i<\/p>\n<p style=\"text-align: justify;\">(5) reprezentan\u021bii angaja\u021bilor\/lucr\u0103torilor ale\u0219i prin vot.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Respectarea dreptului de alegere al salaria\u021bilor<\/strong><\/h2>\n<p style=\"text-align: justify;\">Angajatorul nu poate impune salaria\u021bilor o singur\u0103 variant\u0103 de participare la negocieri. Salaria\u021bii au dreptul de a alege \u00een mod liber \u0219i consim\u021bit varianta prin care vor fi reprezenta\u021bi. Este important ca angajatorul s\u0103 respecte acest drept \u0219i s\u0103 ofere salaria\u021bilor informa\u021biile necesare pentru a-\u0219i exercita op\u021biunea \u00een cuno\u0219tin\u021b\u0103 de cauz\u0103.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Rolul inspectoratelor teritoriale de munc\u0103<\/strong><\/h2>\n<p style=\"text-align: justify;\">Inspectoratele de munc\u0103 au un rol important \u00een monitorizarea respect\u0103rii procedurii de negocieri colective. Acestea au obliga\u021bia de a verifica dac\u0103 procedura a fost respectat\u0103 \u0219i, \u00een caz contrar, pot refuza \u00eenregistrarea.<\/p>\n<h2 style=\"text-align: justify;\"><strong>P\u0103r\u021bile care particip\u0103 la negociere sunt &#8222;egale \u0219i libere&#8221;<\/strong><\/h2>\n<p style=\"text-align: justify;\">\u00cen timpul negocierilor colective, p\u0103r\u021bile sunt recunoscute ca &#8222;egale \u0219i libere&#8221; conform legii. CCM-urile permit negocierea \u0219i stabilirea de clauze specifice pentru fiecare unitate sau chiar pentru un sector sau domeniu de activitate. Chiar dac\u0103 regulamentul intern poate acoperi anumite aspecte, CCM-ul are putere de lege \u00een rela\u021bia dintre p\u0103r\u021bi, spre deosebire de regulament.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Scopul CCM-urilor este de a promova \u0219i ap\u0103ra interesele ambelor p\u0103r\u021bi <\/strong><\/h2>\n<p style=\"text-align: justify;\">Scopul principal al CCM-urilor este de a promova \u0219i ap\u0103ra interesele ambelor p\u0103r\u021bi, de a preveni sau limita conflictele colective de munc\u0103 \u0219i de a asigura o atmosfer\u0103 de pace social\u0103.
