{"id":7619,"date":"2023-05-30T21:48:31","date_gmt":"2023-05-30T18:48:31","guid":{"rendered":"https:\/\/www.lugera.ro\/blog\/?p=7619"},"modified":"2023-06-03T10:49:36","modified_gmt":"2023-06-03T07:49:36","slug":"perioada-de-proba-informatii-utile-pentru-angajatori-natura-si-durata-perioadei-de-proba-a-prevederilor-contractuale-si-a-modului-de-incetare-a-cim","status":"publish","type":"post","link":"https:\/\/www.lugera.ro\/blog\/perioada-de-proba-informatii-utile-pentru-angajatori-natura-si-durata-perioadei-de-proba-a-prevederilor-contractuale-si-a-modului-de-incetare-a-cim\/","title":{"rendered":"Perioada de prob\u0103 &#8211; Informa\u021bii utile pentru angajatori"},"content":{"rendered":"<p style=\"text-align: justify;\">Potrivit legisla\u021biei rom\u00e2ne\u0219ti, perioada de prob\u0103 reprezint\u0103 o perioad\u0103 de timp specificat\u0103 \u00een contractul individual de munc\u0103, \u00een care angajatorul \u0219i angajatul au posibilitatea de a evalua reciproc poten\u021bialul \u0219i adecvarea locului de munc\u0103.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Perioada de prob\u0103 &#8211; n<\/strong><strong>atura acesteia \u0219i preciz\u0103rile din contract<\/strong><\/h2>\n<p style=\"text-align: justify;\"><strong>Perioada de prob\u0103&nbsp;<\/strong><strong>&nbsp;este&nbsp;\u201e<\/strong><em><strong>perioada&nbsp;de timp \u00een care angajatorul poate verifica aptitudinile salariatului<\/strong><\/em><strong>\u201d.<\/strong> Aceast\u0103 verificare este, bine\u00een\u021beles, diferit\u0103 de la companie la companie deoarece specificul activit\u0103\u021bilor, al func\u021biei poate s\u0103 difere destul de mult chiar \u0219i dac\u0103 vorbim, \u00een teorie, de acela\u0219i tip de post, dar \u00een dou\u0103 companii diferite. Acest&nbsp; mod de verificare a aptitudinilor trebuie s\u0103 se reg\u0103seasc\u0103 \u00een regulamentul intern ori contractul colectiv de munc\u0103, dac\u0103 acesta exist\u0103.<\/p>\n<p style=\"text-align: justify;\"><strong>Perioada de prob\u0103 este similar\u0103 oric\u0103rei rela\u021bii de munc\u0103, presupune semnarea unui contract \u0219i ca angajatul s\u0103 beneficieze de toate drepturile aferente oric\u0103rui alt salariat.<\/strong> Nesemnarea contractului de munc\u0103 pentru perioada de prob\u0103 este \u00eencadrat\u0103 ca munc\u0103 nedeclarat\u0103, fiind sanc\u021bionat\u0103 cu amenzi de c\u00e2te 20000 de lei pentru fiecare persoan\u0103 aflat\u0103 \u00een aceast\u0103 situa\u021bie. Trebuie s\u0103 preciz\u0103m totodat\u0103 c\u0103 proba de lucru nu poate fi extins\u0103 pe o perioad\u0103 mai lung\u0103 de timp \u00een vederea test\u0103rii aptitudinilor candidatului. \u0218i \u00een acest caz \u00eencadrarea va fi tot ca munc\u0103 nedeclarat\u0103.&nbsp;<\/p>\n<p style=\"text-align: justify;\">La 22 octombrie 2022 a intrat \u00een vigoare <a href=\"https:\/\/www.lugera.ro\/blog\/modificari-codul-muncii-legea-283-2022\/\">Legea nr. 283\/2022<\/a>, care a modificat semnificativ Codul muncii \u0219i care a adus nout\u0103\u021bi&nbsp; importante \u0219i \u00een ceea ce prive\u0219te&nbsp;<strong>perioada de prob\u0103<\/strong>.&nbsp;<\/p>\n<p style=\"text-align: justify;\">Astfel, \u00een contractul de munc\u0103 trebuie s\u0103 se reg\u0103seasc\u0103 obligatoriu, potrivit Codului Muncii, durata perioadei de prob\u0103. <strong>\u00cen plus fa\u021b\u0103 de durat\u0103, angajatorii mai trebuie s\u0103 precizeze \u00een contract \u0219i condi\u021biile perioadei de prob\u0103<\/strong>, astfel \u00eenc\u00e2t noul angajat s\u0103 \u0219tie de la bun \u00eenceput \u0219i s\u0103 \u00een\u021beleag\u0103 mai bine c\u0103 exist\u0103 riscul termin\u0103rii bru\u0219te a contractului \u00een acea perioad\u0103.<\/p>\n<p style=\"text-align: justify;\"><strong>\u00cen plus, <\/strong>\u00een&nbsp;<a href=\"https:\/\/www.lugera.ro\/blog\/contractele-de-munca-trebuie-sa-includa-elementele-obligatorii-introduse-recent-in-codul-muncii-pana-la-aparitia-noului-model-cadru-de-cim\/\">noul model-cadru al CIM<\/a>, cuprins \u00een Ordinul MMSS nr. 2171\/2022, la lit. D sunt stipulate urm\u0103toarele:<\/p>\n<p style=\"text-align: justify;\"><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/06\/shutterstock_1294831639.jpg\"><img decoding=\"async\" class=\"alignnone size-full wp-image-7620 lazyload\" data-src=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/06\/shutterstock_1294831639.jpg\" alt=\"perioada de proba\" width=\"1000\" height=\"563\" data-srcset=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/06\/shutterstock_1294831639.jpg 1000w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/06\/shutterstock_1294831639-300x169.jpg 300w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/06\/shutterstock_1294831639-768x432.jpg 768w\" data-sizes=\"(max-width: 1000px) 100vw, 1000px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 1000px; --smush-placeholder-aspect-ratio: 1000\/563;\" \/><\/a><br \/>\n<strong>\u201e<em>Perioada de prob\u0103:<\/em><\/strong><\/p>\n<ol style=\"text-align: justify;\">\n<li><em>a) durata de \u2026 zile calendaristice\/lucr\u0103toare, \u00een cazul contractului individual de munc\u0103 pe perioad\u0103 determinat\u0103;<\/em><br \/>\n<em>b) condi\u021biile perioadei de prob\u0103 (dac\u0103 exist\u0103) \u2026<\/em>\u201d.<\/li>\n<\/ol>\n<p style=\"text-align: justify;\"><strong>A\u0219adar, nu exist\u0103 nicio diferen\u021b\u0103 \u00eentre un salariat aflat \u00een perioada de prob\u0103 \u0219i restul salaria\u021bilor<\/strong>, ace\u0219tia av\u00e2nd obliga\u021biile \u0219i drepturile negociate \u00een contractele colective de munc\u0103 sau \u00een cele individuale, fiind obliga\u021bi s\u0103 respecte prevederile regulamentului intern.&nbsp;<\/p>\n<h2 style=\"text-align: justify;\"><strong>Perioada de prob\u0103 &#8211; durata&nbsp;<\/strong><\/h2>\n<p style=\"text-align: justify;\"><strong>Perioada de prob\u0103 are o durat\u0103 maxim\u0103&nbsp;<\/strong>de 90 de zile calendaristice pentru func\u021biile de execu\u021bie \u0219i de cel mult 120 de zile calendaristice pentru func\u021biile de conducere \u00een cazul CIM-urilor cu durat\u0103 nedeterminat\u0103. Pentru contractele cu perioad\u0103 determinat\u0103 poate fi stabilit\u0103 o perioada de prob\u0103 \u00eentre 5 \u0219i 45 de zile, \u00een func\u021bie de durata contractului.&nbsp;<\/p>\n<ul style=\"text-align: justify;\">\n<li>5 zile lucr\u0103toare pentru o durat\u0103 a contractului individual de munc\u0103 mai mic\u0103 de 3 luni;<\/li>\n<li>15 zile lucr\u0103toare pentru o durat\u0103 a contractului individual de munc\u0103 cuprins\u0103 \u00eentre 3 \u0219i 6 luni;<\/li>\n<li>30 de zile lucr\u0103toare pentru o durat\u0103 a contractului individual de munc\u0103 mai mare de 6 luni;<\/li>\n<li>45 de zile lucr\u0103toare \u00een cazul salaria\u021bilor \u00eencadra\u021bi \u00een func\u021bii de conducere, pentru o durat\u0103 a contractului individual de munc\u0103 mai mare de 6 luni.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/06\/shutterstock_2120474384.jpg\"><img decoding=\"async\" class=\"alignnone size-full wp-image-7621 lazyload\" data-src=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/06\/shutterstock_2120474384.jpg\" alt=\"durata perioada de proba\" width=\"1000\" height=\"667\" data-srcset=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/06\/shutterstock_2120474384.jpg 1000w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/06\/shutterstock_2120474384-300x200.jpg 300w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/06\/shutterstock_2120474384-768x512.jpg 768w\" data-sizes=\"(max-width: 1000px) 100vw, 1000px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 1000px; --smush-placeholder-aspect-ratio: 1000\/667;\" \/><\/a><\/p>\n<p style=\"text-align: justify;\">\u00cen situa\u021bia angaja\u021bilor cu dizabilit\u0103\u021bi se aplic\u0103 prevederile Legii 448\/2006, nu cele ale Codului Muncii. Astfel, <strong>perioada de prob\u0103 \u00een cazul persoanelor cu dizabilit\u0103\u021bi <\/strong>ce se \u00eencadreaz\u0103 \u00een baza unui contract pe perioada nedeterminat\u0103 este de minimum 45 de zile lucr\u0103toare \u0219i nu de maximum 30 de zile calendaristice.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Notificarea de \u00eencetare \u00een perioada de prob\u0103&nbsp;<\/strong><\/h2>\n<p style=\"text-align: justify;\">Perioada de prob\u0103 este singura perioad\u0103 \u00een care at\u00e2t&nbsp;angajatorul, c\u00e2t&nbsp;\u0219i salariatul pot avea ini\u021biativa \u00eencet\u0103rii contractului de munc\u0103 f\u0103r\u0103 preaviz \u0219i f\u0103r\u0103 a motiva decizia.&nbsp;&nbsp;Condi\u021bia pentru ca regula \u00eencet\u0103rii rela\u021biei de munc\u0103 f\u0103r\u0103 preaviz s\u0103 se aplice este ca perioada de prob\u0103 s\u0103 fie trecut\u0103 \u00een contract, iar <strong>notificarea<\/strong>&nbsp;de \u00eencetare a rela\u021biilor de munc\u0103 <strong>s\u0103 fie f\u0103cut\u0103 \u00een scris<\/strong>.<\/p>\n<p style=\"text-align: justify;\">\u00cen perioada de prob\u0103 nu poate fi solicitat\u0103 respectarea unui preaviz . Introducerea unei astfel de clauze \u00een contract poate fi sanc\u021bionat\u0103 cu amenzi cuprinse \u00eentre 2000 \u0219i 5000 de lei.&nbsp;<\/p>\n<p style=\"text-align: justify;\">Pe de alt\u0103 parte, dac\u0103 la<strong> schimbarea func\u021biei<\/strong>&nbsp;se stabile\u0219te o nou\u0103 perioad\u0103 de prob\u0103, contractul de munc\u0103&nbsp;<strong>poate \u00eenceta \u00een aceast\u0103 perioad\u0103 printr-o simpl\u0103 notificare scris\u0103<\/strong>&nbsp;din partea angajatorului.<\/p>\n<h2 style=\"text-align: justify;\"><strong><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/06\/shutterstock_1249018027.jpg\"><img decoding=\"async\" class=\"alignnone size-full wp-image-7623 lazyload\" data-src=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/06\/shutterstock_1249018027.jpg\" alt=\"Notificarea de \u00eencetare perioada de prob\u0103\" width=\"1000\" height=\"667\" data-srcset=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/06\/shutterstock_1249018027.jpg 1000w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/06\/shutterstock_1249018027-300x200.jpg 300w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/06\/shutterstock_1249018027-768x512.jpg 768w\" data-sizes=\"(max-width: 1000px) 100vw, 1000px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 1000px; --smush-placeholder-aspect-ratio: 1000\/667;\" \/><\/a><\/strong><\/h2>\n<h2 style=\"text-align: justify;\"><strong>Restric\u021bii la acela\u0219i angajator privind&nbsp;<\/strong><strong>perioada de prob\u0103&nbsp;<\/strong><\/h2>\n<p style=\"text-align: justify;\"><strong>\u00ce<\/strong><strong>n cadrul execut\u0103rii aceluia\u0219i contract de munc\u0103 n<\/strong><strong>u pot exista mai multe perioade de prob\u0103<\/strong>, dar se poate ca, \u00een aceea\u0219i firm\u0103, salariatul s\u0103-\u0219i schimbe func\u021bia \u0219i, atunci, se poate pune problema unei noi perioade de prob\u0103.&nbsp;<\/p>\n<p style=\"text-align: justify;\"><a href=\"https:\/\/www.lugera.ro\/blog\/modificari-codul-muncii-legea-283-2022\/\">Legea nr. 283\/2022<\/a> a venit cu&nbsp; o interdic\u021bie pentru angajator: \u201e<em>Este interzis\u0103 stabilirea unei noi perioade de prob\u0103 \u00een cazul \u00een care, \u00een termen de 12 luni, \u00eentre acelea\u0219i p\u0103r\u021bi se \u00eencheie un nou contract individual de munc\u0103 pentru aceea\u0219i func\u021bie \u0219i cu acelea\u0219i atribu\u021bii<\/em>\u201d.&nbsp;<\/p>\n<h2 style=\"text-align: justify;\"><strong>Alte aspecte de interes<\/strong><\/h2>\n<p style=\"text-align: justify;\">Perioada de prob\u0103 este destul de relevant\u0103&nbsp;<a href=\"https:\/\/www.avocatnet.ro\/articol_56279\"><strong>\u00een cazul concedierii pentru necorespundere profesional\u0103<\/strong><\/a>.&nbsp;<\/p>\n<p style=\"text-align: justify;\">Salariatul nu poate fi obligat s\u0103 pl\u0103teasc\u0103 costurile cursului de formare profesional\u0103&nbsp;suportate de angajator, dec\u00e2t \u00een anumite condi\u021bii dac\u0103 p\u0103r\u0103se\u0219te locul de munc\u0103 \u00een timpul sau la finalul perioadei de prob\u0103.<\/p>\n<p>Sursa foto \u2013&nbsp;<a href=\"https:\/\/www.shutterstock.com\/ro\/search\/young-working-in-the-factory?consentChanged=true\" target=\"_blank\" rel=\"noopener\">Shutterstock.com<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Potrivit legisla\u021biei rom\u00e2ne\u0219ti, perioada de prob\u0103 reprezint\u0103 o perioad\u0103 de timp specificat\u0103 \u00een contractul individual de munc\u0103, \u00een care angajatorul \u0219i angajatul au posibilitatea de a evalua reciproc poten\u021bialul \u0219i adecvarea locului de munc\u0103.
