Ne\u00eencheierea acestuia se \u00eencadreaz\u0103, de asemenea, \u00een categoria muncii nedeclarate.<\/p>\n<h2><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/06\/shutterstock_1911549400.jpg\"><img decoding=\"async\" class=\"alignnone size-full wp-image-7615 lazyload\" data-src=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/06\/shutterstock_1911549400.jpg\" alt=\"V\u00e2rsta de la care unn minor poate \u00eencepe s\u0103 lucreze\" width=\"1000\" height=\"667\" data-srcset=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/06\/shutterstock_1911549400.jpg 1000w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/06\/shutterstock_1911549400-300x200.jpg 300w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/06\/shutterstock_1911549400-768x512.jpg 768w\" data-sizes=\"(max-width: 1000px) 100vw, 1000px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 1000px; --smush-placeholder-aspect-ratio: 1000\/667;\" \/><\/a><\/h2>\n<h2>Programul de lucru \u0219i perioadele de repaus<\/h2>\n<p>Angajatorii trebuie s\u0103 \u021bin\u0103 cont de faptul c\u0103 programul de lucru maxim este de&nbsp;<strong>\u0219ase ore pe zi\/30 de ore pe s\u0103pt\u0103m\u00e2n\u0103, acesta fiind considerat un program full-time<\/strong> pentru salaria\u021bii sub 18 ani. \u00cen situa\u0163ia \u00een care sunt cumulate mai multe func\u0163ii \u00een baza unor contracte individuale de munc\u0103, timpul de munc\u0103 nu poate dep\u0103\u015fi, cumulat, durata maxim\u0103 de \u0219ase ore pe zi\/30 de ore pe s\u0103pt\u0103m\u00e2n\u0103.<\/p>\n<p>Minorii nu pot presta munc\u0103 suplimentar\u0103 <strong>\u0219i nu pot lucra \u00een intervalul<\/strong> 20:00 \u015fi 6:00, \u00een acord cu prevederile <a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/83571\" target=\"_blank\" rel=\"noopener\">HG nr. 600\/2007<\/a>.<\/p>\n<p>De asemenea, \u00eentre dou\u0103 zile de munc\u0103, minorii trebuie s\u0103 beneficieze de o perioad\u0103 minim\u0103 de repaus de 14 ore consecutive.<\/p>\n<p>Pe parcursul unei zile de lucru, dac\u0103 durata zilnic\u0103 de munc\u0103 este mai mare de patru ore \u0219i jum\u0103tate minorii au dreptu la o pauz\u0103 de mas\u0103 de cel pu\u021bin 30 de minute.<\/p>\n<p>Este interzis\u0103 prin lege prestarea muncii suplimentare de c\u0103tre minori.<\/p>\n<p>De asemenea, salaria\u021bii minori primesc cel pu\u021bin&nbsp;<strong>trei zile lucr\u0103toare \u00een plus la concediul de odihn\u0103<\/strong>, iar \u00een conformitate cu prevederile <strong>&nbsp;<a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/83571\" target=\"_blank\" rel=\"noopener\">Hot\u0103r\u00e2rii nr. 600 din 13 iunie 2007<\/a> privind protec\u021bia tinerilor la locul de munc\u0103<\/strong> \u201dangajatorii se asigur\u0103 c\u0103 perioada liber\u0103 de orice munc\u0103 este inclus\u0103, \u00een m\u0103sura posibilului, \u00een cadrul vacan\u0163elor \u015fcolare ale copiilor care fac obiectul \u015fcolariz\u0103rii obligatorii pe baz\u0103 de program integral, impus\u0103 de legisla\u0163ia na\u0163ional\u0103.\u201d<\/p>\n<h2><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/06\/shutterstock_2010529340.jpg\"><img decoding=\"async\" class=\"alignnone size-full wp-image-7614 lazyload\" data-src=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/06\/shutterstock_2010529340.jpg\" alt=\"angajare tineri\" width=\"1000\" height=\"668\" data-srcset=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/06\/shutterstock_2010529340.jpg 1000w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/06\/shutterstock_2010529340-300x200.jpg 300w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/06\/shutterstock_2010529340-768x513.jpg 768w\" data-sizes=\"(max-width: 1000px) 100vw, 1000px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 1000px; --smush-placeholder-aspect-ratio: 1000\/668;\" \/><\/a><\/h2>\n<h2>Sanc\u021biuni<\/h2>\n<p>Angajatorii care nu respect\u0103 regulile de angajare a minorilor nu risc\u0103 doar amenzi, ci chiar pedepse cu \u00eenchisoarea.&nbsp;Articolul 265, alin. (1) din Codul Muncii prevede c\u0103 <em>&#8222;\u00cencadrarea \u00een munc\u0103 a unui minor cu nerespectarea condi\u021biilor legale de v\u00e2rst\u0103 sau folosirea acestuia pentru prestarea unor activit\u0103\u021bi cu \u00eenc\u0103lcarea prevederilor legale referitoare la regimul de munc\u0103 al minorilor constituie infrac\u021biune \u0219i se pedepse\u0219te cu \u00eenchisoare de la 3 luni la 2 ani sau cu amend\u0103<\/em>.\u201d<\/p>\n<h2>S\u0103n\u0103tate \u0219i Securitate \u00een Munc\u0103<\/h2>\n<p><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/06\/shutterstock_1729550884.jpg\"><img decoding=\"async\" class=\"alignnone wp-image-7616 size-full lazyload\" data-src=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/06\/shutterstock_1729550884.jpg\" alt=\"S\u0103n\u0103tate \u0219i Securitate \u00een Munc\u0103 angajarea minorilor\" width=\"1000\" height=\"692\" data-srcset=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/06\/shutterstock_1729550884.jpg 1000w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/06\/shutterstock_1729550884-300x208.jpg 300w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/06\/shutterstock_1729550884-768x531.jpg 768w\" data-sizes=\"(max-width: 1000px) 100vw, 1000px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 1000px; --smush-placeholder-aspect-ratio: 1000\/692;\" \/><\/a><\/p>\n<p>Din perspectiva SSM,&nbsp;\u00een acord cu prevederile Legii 319\/2006, Cap VII, art. 35, <strong>tinerii se \u00eencadreaz\u0103 \u00een grupurile sensibile la riscuri specifice<\/strong> ce trebuie protejate \u00eempotriva pericolelor care le afecteaz\u0103 \u00een mod specific. \u201dAngajatorii au obliga\u0163ia s\u0103 amenajeze locurile de munc\u0103 \u0163in\u00e2nd seama de prezen\u0163a grupurilor sensibile la riscuri specifice\u201d, potrivit prevederilor actului normative men\u021bionat mai sus.<\/p>\n<p><a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/83571\"><em>HG nr. 600\/2007 privind protec\u0163ia tinerilor la locul de munc\u0103<\/em><\/a> define\u0219te, totodat\u0103, no\u021biunea de munc\u0103 u\u0219oar\u0103 \u0219i oblig\u0103 angajatorii s\u0103 asigure tinerilor condi\u0163ii de munc\u0103 adaptate v\u00e2rstei lor. Este<strong> interzis\u0103, \u00een acord cu prevederile actului normativ, angajarea tinerilor pentru activit\u0103\u0163i care<\/strong>:<\/p>\n<ol>\n<li>dep\u0103\u015fesc \u00een mod evident capacit\u0103\u0163ile lor fizice sau psihologice;<\/li>\n<li>implic\u0103 o expunere nociv\u0103 la agen\u0163i toxici, cancerigeni, care determin\u0103 modific\u0103ri genetice ereditare, av\u00e2nd efecte nocive pentru f\u0103t pe durata gravidit\u0103\u0163ii sau av\u00e2nd orice alt efect nociv cronic asupra fiin\u0163ei umane;<\/li>\n<li>implic\u0103 o expunere nociv\u0103 la radia\u0163ii;<\/li>\n<li>prezint\u0103 riscuri de accidentare, pe care se presupune c\u0103 tinerii nu le pot identifica sau preveni, din cauza aten\u0163iei insuficiente pe care o acord\u0103 securit\u0103\u0163ii \u00een munc\u0103, a lipsei lor de experien\u0163\u0103 ori de preg\u0103tire;<\/li>\n<li>pun \u00een pericol s\u0103n\u0103tatea acestora din cauza frigului ori a c\u0103ldurii extreme sau din cauza zgomotului ori a vibra\u0163iilor.<\/li>\n<\/ol>\n<p>HG 600\/2007 mai precizeaz\u0103, totodat\u0103, c\u0103 printre activit\u0103\u0163ile \u015fi procedeele care sunt susceptibile s\u0103 antreneze riscuri specifice pentru tineri figureaz\u0103, \u00een special activit\u0103\u0163ile care implic\u0103 o expunere nociv\u0103 la agen\u0163ii fizici, biologici \u015fi chimici prev\u0103zu\u0163i la pct. I din anexa HG 600, dar \u0219i \u0219i procedeele \u015fi activit\u0103\u0163ile prev\u0103zute la pct.
