Av\u00e2nd \u00een vedere c\u0103 legea nu distinge \u00eentre angaja\u021bii pe perioad\u0103 determinat\u0103 sau cei pe perioad\u0103 nedeterminat\u0103 atunci c\u00e2nd impune obliga\u021bia negocierii colective, dac\u0103 un angajator atinge sau dep\u0103\u0219e\u0219te num\u0103rul de zece angaja\u021bi doar sezonier, la momentul respectiv \u201edob\u00e2nde\u0219te\u201d \u0219i obliga\u021bia de a ini\u021bia negocierile.<\/p>\n<h2><strong>Negocierea colectiv\u0103 obligatorie indiferent de tipul de contract<\/strong><\/h2>\n<p>Prevederile Legii speciale nr. 367\/2022 se aplic\u0103 indiferent dac\u0103 angaja\u021bii sunt \u00eencadra\u021bi cu norm\u0103 \u00eentreag\u0103 sau par\u021bial\u0103, cu contracte de munc\u0103 pe perioad\u0103 determinat\u0103 sau nedeterminat\u0103.<\/p>\n<h2><strong>Prevederile Codului Muncii nu prevaleaz\u0103 \u00een situa\u021bia obliga\u021biei de a negocia colectiv \u00een cazul companiilor care au \u00eentre 10 \u0219i 20 de angaja\u021bi<\/strong><\/h2>\n<p><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/06\/shutterstock_2279449971.jpg\"><img decoding=\"async\" class=\"alignnone size-full wp-image-7583 lazyload\" data-src=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/06\/shutterstock_2279449971.jpg\" alt=\"Negocierea colectiva\" width=\"1000\" height=\"750\" data-srcset=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/06\/shutterstock_2279449971.jpg 1000w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/06\/shutterstock_2279449971-300x225.jpg 300w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/06\/shutterstock_2279449971-768x576.jpg 768w\" data-sizes=\"(max-width: 1000px) 100vw, 1000px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 1000px; --smush-placeholder-aspect-ratio: 1000\/750;\" \/><\/a>Codul muncii nu a fost \u00eenc\u0103 actualizat \u00een acest sens \u0219i prevede \u00een continuare aceea\u0219i regul\u0103 ca vechea lege a dialogului social: \u201e<em>Negocierea colectiv\u0103 la nivel de unitate este obligatorie, cu excep\u0163ia cazului \u00een care angajatorul are \u00eencadra\u0163i mai pu\u0163in de 21 de salaria\u0163i<\/em>\u201d.&nbsp; Prevederile acestuia nu prevaleaz\u0103, \u00eens\u0103, \u00een orice situa\u021bie, iar \u00een situa\u021bia obliga\u021biei ini\u021bierii negocierilor colective&nbsp;<strong>Codul muncii este doar legea general\u0103, iar Legea dialogului social este cea special\u0103,<\/strong>&nbsp;cea la care ne vom raporta atunci c\u00e2nd este evaluat\u0103 situa\u021bia angajatorilor care au obliga\u021bia de a demara negocierile colective.<\/p>\n<h2><strong>Amenzi pentru nerespectarea obliga\u021biei legate de negocierea colectiv\u0103<\/strong><\/h2>\n<p>Reamintim, totodat\u0103, \u00een acest context, c\u0103, \u00een cazul unui control, angajatorii care nu \u0219i-au \u00eendeplinit obliga\u021bia de a demara negocierile colective risc\u0103 o amend\u0103<strong>&nbsp;<\/strong>de la 15.000 de lei la 20.000 de lei, iar necunoa\u0219terea legii nu poate fi invocat\u0103.&nbsp;<\/p>\n<p>Sursa foto&nbsp;<a href=\"https:\/\/www.shutterstock.com\/ro\/search\/undeclared-work\" target=\"_blank\" rel=\"noopener\">shutterstock.com<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>\u00cen acord cu prevederile&nbsp;Legii nr. 367\/2022 privind dialogul social, negocierea colectiv\u0103 este \u00een prezent obligatorie&nbsp;\u00een cazul angajatorilor care au cel pu\u021bin 10 salaria\u021bi.
