Art. 118 din CM prevede <strong>at\u00e2t dreptul angajatorului&nbsp;<\/strong>de a stabili un program individualizat de munc\u0103,&nbsp;<strong>c\u00e2t \u0219i dreptul oric\u0103rui salariat de a solicita stabilirea unui astfel de program<\/strong>, \u00eens\u0103 la baz\u0103 r\u0103m\u00e2ne acordul de voin\u021b\u0103 al p\u0103r\u021bilor.<\/p>\n<p style=\"text-align: justify;\">Astfel, angajatorul ar putea stabili astfel de programe individualizate de munc\u0103, cu precizarea c\u0103 salariatul vizat trebui s\u0103-\u0219i exprime acordul.<\/p>\n<p style=\"text-align: justify;\">La r\u00e2ndul s\u0103u orice salariat ar putea s\u0103 solicite acest lucru angajatorului s\u0103u, iar acesta va putea s\u0103 refuze, \u00eens\u0103 numai \u00een cazul \u00een care exist\u0103 motive justificate, acestea fiind comunicate \u00een scris salariatului \u00een cel mult cinci zile din momentul solicit\u0103rii.&nbsp;<\/p>\n<p style=\"text-align: justify;\">Programul individualizat este un mod flexibil de organizare a timpului de munc\u0103, flexibilitatea fiind, la r\u00e2ndul ei, definit\u0103 ca o adaptare a programului de lucru prin utilizarea uneia sau a mai multor variante de executare a contractului de munc\u0103, inclusiv telemunc\u0103 \u0219i hibrid.<\/p>\n<p style=\"text-align: justify;\">Pe l\u00e2ng\u0103 salaria\u021bii care-\u0219i desf\u0103\u0219oar\u0103 activitatea la domiciliu \u0219i pentru care Codul Muncii precizeaz\u0103 explicit c\u0103-\u0219i stabilesc singuri programul de lucru, pentru celelalte categorii de salaria\u021bi se va aplica aceea\u0219i regul\u0103 a predictibilit\u0103\u021bii.<\/p>\n<p style=\"text-align: justify;\"><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/05\/shutterstock_2136984027.jpg\"><img decoding=\"async\" class=\"alignnone size-full wp-image-7551 lazyload\" data-src=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/05\/shutterstock_2136984027.jpg\" alt=\"Programul individualizat1\" width=\"1000\" height=\"667\" data-srcset=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/05\/shutterstock_2136984027.jpg 1000w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/05\/shutterstock_2136984027-300x200.jpg 300w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/05\/shutterstock_2136984027-768x512.jpg 768w\" data-sizes=\"(max-width: 1000px) 100vw, 1000px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 1000px; --smush-placeholder-aspect-ratio: 1000\/667;\" \/><\/a><\/p>\n<p style=\"text-align: justify;\">Astfel,&nbsp;<strong>pentru telesalaria\u021bi avem o precizare clar\u0103 privind modul \u00een care se organizeaz\u0103 programul de munc\u0103, fiind necesar acordul p\u0103r\u021bilor<\/strong>, \u00een acord cu prevederile art. 4 alin (1) din Legea 81\/2018.<\/p>\n<p style=\"text-align: justify;\"><strong>\u00cen cazul salaria\u021bilor \u00eencadra\u021bi cu timp par\u021bial<\/strong>, pe l\u00e2ng\u0103 precizarea expres\u0103 privind interdic\u021bia de a presta munc\u0103 suplimentar\u0103, Codul Muncii impune stabilirea \u0219i includerea \u00een contractul individual de munc\u0103 cu timp par\u021bial a condi\u021biilor \u00een care se poate modifica programul de lucru.<\/p>\n<p style=\"text-align: justify;\">Pentru salaria\u021bii care \u00ee\u0219i desf\u0103\u0219oar\u0103 activitatea \u00eentr-un loc de munc\u0103 fix \u0219i organizat de c\u0103tre angajator, avem dou\u0103 situa\u021bii posibile, una \u00een care programul de munc\u0103 este dependent de acordul p\u0103r\u021bilor \u0219i una \u00een care, de\u0219i avem o condi\u021bie privind acest acord, este luat\u0103 \u00een calcul predictibilitatea \u0219i consultarea \u0219i informarea salaria\u021bilor, dar \u0219i posibilitatea contest\u0103rii unei eventuale decizii prin care unui salariat \u00eei sunt \u00eenc\u0103lcate drepturile.<\/p>\n<p style=\"text-align: justify;\">Prima situa\u021bie este legat\u0103 de programul individualizat care poate fi stabilit at\u00e2t la ini\u021biativa angajatorului, c\u00e2t \u0219i la cea a salariatului, cu sublinierea faptului c\u0103 angajatorul poate refuza justificat, motiv\u00e2nd \u00een scris acest refuz.<\/p>\n<p style=\"text-align: justify;\">Concret,&nbsp;<strong>\u00een momentul \u00een care p\u0103r\u021bile, de comun acord, au stabilit un program individualizat, modificarea sa este posibil\u0103 \u00een acelea\u0219i condi\u021bii<\/strong>, deci tot de comun acord.<\/p>\n<p style=\"text-align: justify;\">\u00cen cea de-a doua situa\u021bie, de\u0219i \u00een modelul-cadru al contractului individual de munc\u0103 este precizat faptul c\u0103 programul de lucru se poate modifica, acest lucru este posibil \u00een condi\u021biile prev\u0103zute \u00een regulamentul intern sau \u00een contractul colectiv de munc\u0103, adic\u0103 tot prin negociere sau cel pu\u021bin cu consultarea salaria\u021bilor.<\/p>\n<p style=\"text-align: justify;\"><strong>Programul de munc\u0103 individualizat este o excep\u021bie de la regula general\u0103 a repartiz\u0103rii timpului de munc\u0103 \u00een cadrul s\u0103pt\u0103m\u00e2nii, fapt care impune precizarea expres\u0103 \u00een contractul individual de munc\u0103<\/strong>, oricare ar fi tipul sau felul acestui contract.<\/p>\n<p style=\"text-align: justify;\"><strong>Legiuitorul nu a prev\u0103zut \u00een niciuna dintre situa\u021bii posibilitatea ca programul de munc\u0103 s\u0103 fie unul imprevizibil, ci a subliniat nevoia unui acord \u00eentre p\u0103r\u021bi \u00een acest sens. <\/strong>\u00cen ultima variant\u0103, cea a stabilirii sale prin regulament intern, sunt incidente dispozi\u021biile privind consultarea colectiv\u0103 a salaria\u021bilor \u0219i cele privind modul de contestare a dispozi\u021biilor acestuia.<\/p>\n<p>Sursa foto <a href=\"https:\/\/www.shutterstock.com\/ro\/search\/work-schedule\" target=\"_blank\" rel=\"noopener\">shutterstock.com<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Organizarea flexibil\u0103 a timpului de lucru d\u0103 salaria\u021bilor posibilitatea de a \u00ee\u0219i adapta programul, inclusiv prin utilizarea formulelor de munc\u0103 la distan\u021b\u0103, a programelor de munc\u0103 flexibile, a programelor individualizate de munc\u0103 sau a unor programe de munc\u0103 cu timp redus de lucru.
