Angajatorul e cel care poate decide ora la care trebuie s\u0103 \u00eenceap\u0103 activitatea \u0219i dac\u0103 este necesar\u0103 organizarea \u00een schimburi. De cealalt\u0103 parte, angajatul are nevoie de predictibilitate.&nbsp; &nbsp;<\/p>\n<p style=\"text-align: justify;\">Pentru a p\u0103stra echilibrul \u00eentre drepturile \u0219i obliga\u021biile celor dou\u0103 p\u0103r\u021bi ale contractului de munc\u0103 \u00een privin\u021ba repartiz\u0103rii timpului de munc\u0103 programul de lucru trebuie s\u0103 se \u00eencadreze \u00een limitele timpului de munc\u0103 prev\u0103zut \u00een contract, iar pentru munca suplimentar\u0103 este nevoie de acordul angajatorului \u0219i al salariatului.<\/p>\n<p style=\"text-align: justify;\">\u00cen primul r\u00e2nd este important s\u0103 preciz\u0103m c\u0103 indiferent de tipul activit\u0103\u021bii derulate programul de lucru trebuie s\u0103 se \u00eencadreze \u00een timpul de munc\u0103 prev\u0103zut \u00een contract, iar&nbsp;<strong>angajatorul trebuie s\u0103 ia m\u0103surile necesare pentru a se asigura c\u0103 timpul de munc\u0103 este respectat<\/strong>&nbsp;sau, atunci c\u00e2nd solicit\u0103 prestarea muncii suplimentare, c\u0103 sunt respectate toate dispozi\u021biile legale.<\/p>\n<p style=\"text-align: justify;\">Timpul de munc\u0103 este definit de Codul muncii ca fiind \u201e<em>orice perioad\u0103 \u00een care salariatul presteaz\u0103 munca, se afl\u0103 la dispozi\u021bia angajatorului \u0219i \u00ee\u0219i \u00eendepline\u0219te sarcinile \u0219i atribu\u021biile<\/em>\u201d, iar tot ce dep\u0103\u0219e\u0219te acest interval intr\u0103 \u00een categoria muncii suplimentare. \u00cen\u021belegem, a\u0219adar, c\u0103 programul de munc\u0103 este, ca regul\u0103, un aspect<strong>&nbsp;<\/strong><strong>previzibil \u0219i asumat<\/strong>&nbsp;\u00eenc\u0103 de la momentul semn\u0103rii contractului individual de munc\u0103, iar timpul de munc\u0103 este un element esen\u021bial din contract care poate fi modificat doar prin acordul p\u0103r\u021bilor.<\/p>\n<p style=\"text-align: justify;\">De asemenea, \u00een conformitate cu art. 41 alin. (3) din Constitu\u021bie, Codul muncii a prev\u0103zut c\u0103 durata normal\u0103 a timpului de munc\u0103 de opt ore pe zi \u0219i de 40 de ore pe s\u0103pt\u0103m\u00e2n\u0103 pentru salaria\u021bii angaja\u021bi cu norm\u0103 \u00eentreag\u0103, iar pentru cei angaja\u021bi cu timp par\u021bial &#8211; interdic\u021bia prest\u0103rii \u00een afara timpului de munc\u0103 prev\u0103zut \u00een contract.<\/p>\n<p style=\"text-align: justify;\">\u00cen\u021belegem a\u0219adar c\u0103 <strong>niciun salariat \u00eencadrat cu timp par\u021bial nu ar putea presta \u00een afara timpului de munc\u0103 prev\u0103zut \u00een contract<\/strong>, iar dac\u0103 ne raport\u0103m \u0219i la dispozi\u021biile art. 15^1 lit. d) \u0219i ale art. 260 alin (1) lit. e^3), putem discuta chiar despre munc\u0103 nedeclarat\u0103 \u0219i despre o amend\u0103 de la 10.000 la 15.000 de lei pentru fiecare persoan\u0103 identificat\u0103.<\/p>\n<p style=\"text-align: justify;\"><strong><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/05\/shutterstock_1556874404.jpg\"><img decoding=\"async\" class=\"alignnone size-full wp-image-7517 lazyload\" data-src=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/05\/shutterstock_1556874404.jpg\" alt=\"Timpul de munc\u0103\" width=\"1000\" height=\"667\" data-srcset=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/05\/shutterstock_1556874404.jpg 1000w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/05\/shutterstock_1556874404-300x200.jpg 300w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/05\/shutterstock_1556874404-768x512.jpg 768w\" data-sizes=\"(max-width: 1000px) 100vw, 1000px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 1000px; --smush-placeholder-aspect-ratio: 1000\/667;\" \/><\/a><\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>Pentru munca suplimentar\u0103 sunt necesare at\u00e2t solicitarea angajatorului, c\u00e2t \u0219i acordul salariatului<\/strong>, \u00een acord cu prevederile art. 120 alin (2) \u0219i art. 121 din Codul muncii.<\/p>\n<p style=\"text-align: justify;\">\u00cen cazul unui program de lucru inegal, p\u0103r\u021bile vor \u021bine cont at\u00e2t de limitarea privind timpul de munc\u0103 s\u0103pt\u0103m\u00e2nal, c\u00e2t \u0219i de faptul c\u0103 un astfel de program poate func\u021biona numai dac\u0103 este expres men\u021bionat \u00een <a href=\"https:\/\/www.lugera.ro\/blog\/aspecte-pe-care-angajatorul-trebuie-sa-le-comunice-in-faza-negocierii-contractului-individual-de-munca\/\">contractul individual de munc\u0103<\/a>.<\/p>\n<p style=\"text-align: justify;\"><strong>Programul individualizat<\/strong>, <a href=\"https:\/\/www.lugera.ro\/blog\/modificari-codul-muncii-legea-283-2022\/#Programul_de_lucru\" target=\"_blank\" rel=\"noopener\">nou introdus \u00een Codul muncii<\/a>,&nbsp;<strong>poate fi stabilit, de asemenea, prin acordul p\u0103r\u021bilor<\/strong>, fie la ini\u021biativa angajatorului \u0219i cu acordul salariatului, fie la solicitarea salariatului, \u00een m\u0103sura \u00een care activitatea unit\u0103\u021bii permite o astfel de abordare.<\/p>\n<p style=\"text-align: justify;\">Indiferent de situa\u021bie, pe l\u00e2ng\u0103 principiile generale care guverneaz\u0103 rela\u021biile de munc\u0103, buna-credin\u021b\u0103 \u0219i consensualitatea, inclusiv&nbsp;<strong>atunci c\u00e2nd angajatorul \u00eei solicit\u0103 salariatului s\u0103 lucreze suplimentar<\/strong>, adic\u0103 peste norma \u00eentreag\u0103 din contract,&nbsp;<strong>timpul respectiv va fi eviden\u021biat \u0219i compensat<\/strong>, fie prin acordarea de ore libere pl\u0103tite \u00een termenul legal, fie prin plata sporului negociat, conform art. 122 \u0219i 123 din Codul muncii.<\/p>\n<p style=\"text-align: justify;\">Astfel, constat\u0103m c\u0103&nbsp;<strong>nu poate fi obligat lucr\u0103torul s\u0103 se prezinte \u00eenainte de \u00eenceperea programului ori s\u0103 r\u0103m\u00e2n\u0103 peste program, fiind necesar acordul acestuia<\/strong>, iar \u00een cazul \u00een care ar fi de acord, perioada respectiv\u0103 de timp va fi eviden\u021biat\u0103 corespunz\u0103tor, potrivit art. 119 din Codul muncii, cu precizarea orelor de \u00eencepere \u0219i de sf\u00e2r\u0219it ale programului de lucru.<\/p>\n<p style=\"text-align: justify;\">Trebuie totodat\u0103 avut \u00een vedere faptul c\u0103, \u00een cazul unui control \u0219i atunci c\u00e2nd nu respect\u0103 dispozi\u021biile legale privind munca suplimentar\u0103, angajatorul risc\u0103, \u00een acord cu prevederile art. 260 alin (1) lit. i), o amend\u0103 cuprins\u0103 \u00eentre 1.500 la 3.000 de lei pentru fiecare persoan\u0103 identificat\u0103, iar \u00een cazul contractelor cu timp par\u021bial, inclusiv despre munc\u0103 nedeclarat\u0103.<\/p>\n<p style=\"text-align: justify;\">Photo credit<a href=\"https:\/\/www.shutterstock.com\/ro\/search\/working-schedule\" target=\"_blank\" rel=\"noopener\"> shutterstock.com<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Organizarea \u0219i func\u021bionarea firmei \u021bin de decizia angajatorului, acesta fiind \u00een m\u0103sur\u0103 s\u0103 decid\u0103 num\u0103rul \u0219i tipul de posturi de care are nevoie pentru activitatea sa, dar \u0219i norma de munc\u0103.
