Aspecte importante."},"content":{"rendered":"<p style=\"text-align: justify;\">La finalul anului trecut obliga\u0163ia de a negocia colectiv a fost extins\u0103 \u015fi la nivelul unit\u0103\u0163ilor care au cel pu\u0163in 10 angaja\u0163i\/ lucr\u0103tori, fapt care a readus pe agenda oamenilor de HR subiectul contractelor colective de munc\u0103, necesitatea de a le aduce \u00een aten\u021bie angaja\u021bilor c\u0103 \u00ee\u0219i pot alege reprezentan\u021bi, cum se procedeaz\u0103 \u00een acest sens, dar \u0219i ce se \u00eent\u00e2mpl\u0103 sau ce ar trebui s\u0103 fac\u0103 dac\u0103 angaja\u021bii nu sunt interesa\u021bi de negocieri sau nici chiar de a fi reprezentan\u021bi \u00een discu\u021biile cu angajatorii.<\/p>\n<p style=\"text-align: justify;\">Sintetiz\u0103m cele mai importante aspecte legate de obliga\u0163ia de a negocia colectiv.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Extinderea obliga\u0163iei&nbsp;<\/strong><\/h2>\n<p style=\"text-align: justify;\">Dup\u0103 cum men\u021bionam anterior, de la finalul anului trecut obliga\u021bia de a ini\u021bia negocierea colectiv\u0103 este obligatorie \u0219i la nivelul unit\u0103\u0163ilor care au \u00eentre 10 \u0219i 20 de angaja\u021bi, nu doar pentru cele care au cel pu\u021bin 21 de angaja\u021bi, \u00een acord cu prevederile legii <a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/262989\" target=\"_blank\" rel=\"noopener\"><strong> 367\/2022<\/strong><\/a>.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Termenul pentru desf\u0103\u0219urarea negocierilor colective<\/strong><\/h2>\n<p style=\"text-align: justify;\">Noua lege a redus&nbsp;<strong>termenul pentru desf\u0103\u0219urarea negocierilor colective de la 60 la 45 de zile. <\/strong>Totodat\u0103, prevederea care d\u0103 posibilitatea ca acest termen s\u0103 fie prelungit prin acordul celor implica\u021bi este \u00een continuare valabil\u0103.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Refuzul de a negocia<\/strong><\/h2>\n<p style=\"text-align: justify;\">De\u0219i ini\u021biativa negocierilor apar\u021bine acum ambelor p\u0103r\u021bi, <strong>angajatorul este singurul care poate fi sanc\u021bionat pentru refuzul de a negocia. <\/strong>Iar cuantumul acestei amenzi a crescut de la amenzi cuprinse \u00eentre 5000 \u0219i 10.000 de lei, la amenzi cuprinse \u00eentre 15.000 \u0219i 20.000 de lei.<\/p>\n<p style=\"text-align: justify;\">Av\u00e2nd \u00een vedere c\u0103 nu \u00eentotdeauna este posibil\u0103 finalizarea cu succes a negocierilor, angajatorii trebuie s\u0103 fie \u00een m\u0103sur\u0103 s\u0103 poat\u0103 dovedi cu documente c\u0103 \u0219i-au \u00eendeplinit obliga\u021bia prev\u0103zut\u0103 de lege.&nbsp;Astfel:<\/p>\n<ul>\n<li style=\"text-align: justify;\">Angajatorul va comunica salaria\u021bilor faptul c\u0103 negocierea colectiv\u0103 este obligatorie la nivelul unit\u0103\u021bii, raportat la num\u0103rul de salaria\u021bi, \u0219i c\u0103, pentru a-\u0219i exercita dreptul prev\u0103zut de Constitu\u021bie \u0219i de Codul Muncii, trebuie fie s\u0103 \u00eenfiin\u021beze un sindicat (sau s\u0103 se \u00eenscrie \u00een unul deja \u00eenfiin\u021bat la nivel sectorial), fie s\u0103 \u00ee\u0219i aleag\u0103 reprezentan\u021bii \u00een cadrul unei adun\u0103ri generale.<\/li>\n<li style=\"text-align: justify;\">Angajatorul transmite \u00een scris tuturor p\u0103r\u021bilor \u00eendrept\u0103\u021bite s\u0103 negocieze contractul colectiv de munc\u0103 inten\u021bia de \u00eencepere a negocierilor colective, cu cel pu\u021bin 15 zile \u00eenainte de \u00eenceperea acestora. Acolo unde salaria\u021bii nu sunt organiza\u021bi \u00eenc\u0103, angajatorul ar putea stabili o perioad\u0103 mai mare. Invita\u021bia va fi transmis\u0103 \u00een scris, acest \u00eenscris fiind chiar dovada \u00eendeplinirii obliga\u021biei, iar \u00een cazul \u00een care fie exist\u0103 o organiza\u021bie sindical\u0103 care \u00eendepline\u0219te condi\u021biile legale, fie sunt ale\u0219i reprezentan\u021bii salaria\u021bilor, este necesar\u0103 confirmarea, tot \u00een scris, a primirii invita\u021biei.<\/li>\n<li style=\"text-align: justify;\">\u00cen cazul \u00een care angaja\u021bii, de\u0219i organiza\u021bi, \u00eentr-o form\u0103 sau alta, refuz\u0103 negocierea sau nu r\u0103spund invita\u021biei, iar angajatorul poate face dovada invit\u0103rii la negociere, \u00een acord cu Legea 367\/2022 se consider\u0103 ca fiind tot un refuz de participare.<\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/03\/shutterstock_1848532318.jpg\"><img decoding=\"async\" class=\"alignnone size-full wp-image-7450 lazyload\" data-src=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/03\/shutterstock_1848532318.jpg\" alt=\"\" width=\"1000\" height=\"667\" data-srcset=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/03\/shutterstock_1848532318.jpg 1000w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/03\/shutterstock_1848532318-300x200.jpg 300w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/03\/shutterstock_1848532318-768x512.jpg 768w\" data-sizes=\"(max-width: 1000px) 100vw, 1000px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 1000px; --smush-placeholder-aspect-ratio: 1000\/667;\" \/><\/a><\/h2>\n<h2 style=\"text-align: justify;\">Angajatorul trebuie s\u0103 fac\u0103 dovada \u00eendeplinirii \u00eendatoririlor legale<\/h2>\n<p style=\"text-align: justify;\">\u00cen cazul \u00een care angaja\u021bii nu sunt interesa\u021bi s\u0103 \u00ee\u0219i desemneze un reprezentant \u0219i s\u0103 participe la discu\u021bii pentru CCM angajatorul nu poate s\u0103 fie tras la r\u0103spundere pentru c\u0103 angaja\u021bii nu au vrut s\u0103 participe la negocieri, at\u00e2ta vreme c\u00e2t poate dovedi, f\u0103r\u0103 dubiu, c\u0103 \u0219i-a \u00eendeplinit toate celelalte \u00eendatoriri legale \u00een materia negocierii colective.&nbsp;<\/p>\n<h2 style=\"text-align: justify;\"><strong>Angajatorul nu poate interveni \u00een procesul de alegere a reprezentan\u021bilor<\/strong><\/h2>\n<p style=\"text-align: justify;\"><strong>Aten\u021bie! <\/strong>Angajatorii pot fi amenda\u021bi dac\u0103 intervin \u00een procesul de alegere a reprezentan\u021bilor angaja\u021bilor.&nbsp;Angajatorul poate, cel mult, facilita desf\u0103\u0219urarea procedurilor de alegere,&nbsp;\u00eens\u0103 numai \u00een situa\u021bia \u00een care prime\u0219te o solicitare \u00een acest sens din partea lucr\u0103torilor\/salaria\u021bilor.<\/p>\n<h2 style=\"text-align: justify;\"><strong><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/03\/shutterstock_1989137774.jpg\"><img decoding=\"async\" class=\"alignnone size-full wp-image-7451 lazyload\" data-src=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/03\/shutterstock_1989137774.jpg\" alt=\"negociere colectiv\u0103\" width=\"1000\" height=\"750\" data-srcset=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/03\/shutterstock_1989137774.jpg 1000w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/03\/shutterstock_1989137774-300x225.jpg 300w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/03\/shutterstock_1989137774-768x576.jpg 768w\" data-sizes=\"(max-width: 1000px) 100vw, 1000px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 1000px; --smush-placeholder-aspect-ratio: 1000\/750;\" \/><\/a><\/strong><\/h2>\n<h2 style=\"text-align: justify;\"><strong>Num\u0103rul maxim\/ minim de reprezentan\u021bi<\/strong><\/h2>\n<p style=\"text-align: justify;\">Noua lege a dialogului social nu impune angaja\u021bilor&nbsp;<strong>un num\u0103r maxim sau minim de reprezentan\u021bi<\/strong>, ci&nbsp;stabile\u0219te ca regul\u0103 acordul p\u0103r\u021bilor &#8211; angaja\u021bi \u0219i angajator.
