Iat\u0103 care sunt cele mai importante aspecte pe care trebuie s\u0103 le avem \u00een vedere \u00een formarea profesional\u0103 2023:<\/p>\n<h2 style=\"text-align: justify;\"><strong>Informarea prealabil\u0103<\/strong><\/h2>\n<p style=\"text-align: justify;\"><strong>Dreptul \u0219i condi\u021biile privind formarea profesional\u0103 oferit\u0103 de angajator<\/strong> vor face obiectul inform\u0103rii prealabile pe care angajatorul trebuie s\u0103 o fac\u0103 celui pe care-l angajeaz\u0103, stabile\u0219te <a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/260561\" target=\"_blank\" rel=\"noopener\">Legea 283\/2022<\/a> care a modificat \u00een octombrie 2022 Codul muncii. \u00cen cazul nerespect\u0103rii acestei obliga\u021bii \u0219i \u00een lipsa unei inform\u0103ri complete angajatul poate sesiza oric\u00e2nd ITM-ul \u0219i poate cere inclusiv desp\u0103gubiri.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Regulamentul intern<\/strong><\/h2>\n<p style=\"text-align: justify;\">Regulamentul intern va cuprinde \u00een mod obligatoriu \u0219i \u201d<em>informa\u021bii cu privire la politica general\u0103 de formare a salaria\u021bilor, dac\u0103 exist\u0103<\/em>\u201d.&nbsp;<\/p>\n<h2 style=\"text-align: justify;\">To\u021bi&nbsp;<strong>angajatorii sunt obliga\u021bi s\u0103 asigure formarea profesional\u0103<\/strong><\/h2>\n<p style=\"text-align: justify;\">\u00cen func\u021bie de num\u0103rul de salaria\u021bi, periodicitatea \u00eendeplinirii acestei obliga\u021bii va fi diferit\u0103. Angajatorii care au mai pu\u021bin de 21 de salaria\u021bi au obliga\u021bia de a asigura acestora accesul la programe de formare profesional\u0103 cel pu\u021bin o dat\u0103 la trei ani. \u00cen cazul \u00een care au cel pu\u021bin 21 de salaria\u021bi, accesul la formare profesional\u0103 va fi asigurat fiec\u0103rui salariat la \u00eentr-un interval de cel mult doi ani.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Obliga\u021bia de a avea un plan de formare profesional\u0103<\/strong><\/h2>\n<p style=\"text-align: justify;\"><a href=\"https:\/\/www.lugera.ro\/blog\/angajatorii-au-obligatia-sa-prezinte-tuturor-salariatilor-politica-de-formare-profesionala\/\" target=\"_blank\" rel=\"noopener\"><strong>Angajatorii care au mai mult de 20 de salaria\u021bi elaboreaz\u0103 anual \u0219i aplic\u0103 planuri de formare profesional\u0103<\/strong><\/a>, cu consultarea sindicatului sau a reprezentan\u021bilor salaria\u021bilor. Dac\u0103 exist\u0103 un contract colectiv, planul de formare va fi anexat acestuia. Oricare ar fi situa\u021bia, dac\u0103 exist\u0103 sau nu un contract colectiv de munc\u0103, angaja\u021bii trebuie s\u0103 fie informa\u021bi de con\u021binutul acestui document.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Salariatul poate refuza participarea la un program de formare profesional\u0103<\/strong><\/h2>\n<p style=\"text-align: justify;\">\u00cen cazul \u00een care angajatorul condi\u021bioneaz\u0103 participarea la programele de formare de semnarea unui act adi\u021bional prin care salariatul s\u0103-\u0219i asume c\u0103 nu poate \u00eenceta contractul de munc\u0103 pentru o anumit\u0103 perioad\u0103, \u00een situa\u021bia \u00een care perioada nu este just\u0103 sau costurile pe care ar urma s\u0103 le suporte nu justific\u0103 obliga\u021bia, angajatul poate refuza participarea la cursurile de formare profesional\u0103.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Angaja\u021bii au dreptul s\u0103 solicite concediu pl\u0103tit pentru formarea profesional\u0103<\/strong><\/h2>\n<p style=\"text-align: justify;\">\u00cen cazul \u00een care angajatorul nu \u00ee\u0219i respect\u0103 <strong>obliga\u021bia de a asigura formarea profesional\u0103 <\/strong>salaria\u021bii pot solicita un concediu pl\u0103tit pentru formare profesional\u0103, de p\u00e2n\u0103 la 10 zile lucr\u0103toare sau p\u00e2n\u0103 la 80 ore.<\/p>\n<p style=\"text-align: justify;\">Potrivit art. 157 din Codul muncii \u00een situa\u021bia \u00een care \u00een care angajatorul nu \u00ee\u0219i <strong>obliga\u021bia de formare profesional\u0103<\/strong>,&nbsp;<strong>salariatul poate urma un curs de formare profesional\u0103 din ini\u021biativa \u0219i pe cheltuiala sa, cu sau f\u0103r\u0103 leg\u0103tur\u0103 cu domeniul de activitate al angajatorului sau cu postul pe care acesta \u00eel ocup\u0103<\/strong>, iar&nbsp;<strong>angajatorul va suporta indemniza\u021bia de concediu pentru formare profesional\u0103<\/strong>, aceasta fiind identic\u0103 cu cea prev\u0103zut\u0103 pentru concediul de odihn\u0103 anual.<\/p>\n<p style=\"text-align: justify;\">Perioada petrecut\u0103 de salariat \u00een concediul pl\u0103tit pentru formare trebuie s\u0103 fac\u0103 obiectul unui acord cu angajatorul, iar cererea de concediu pl\u0103tit trebuie s\u0103 fie \u00eenaintat\u0103 cu cel pu\u021bin o lun\u0103 \u00eenainte de efectuarea acestuia \u0219i va cuprinde informa\u021bii legate de data de \u00eencepere a stagiului de formare, domeniul, durata acestuia \u0219i denumirea institu\u021biei care asigur\u0103 formarea.<\/p>\n<h2 style=\"text-align: justify;\"><strong><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/02\/everyone-is-smiling-listens-group-people-business-conference-modern-classroom-daytime-scaled.jpg\"><img decoding=\"async\" class=\"alignnone wp-image-7365 size-large lazyload\" data-src=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/02\/everyone-is-smiling-listens-group-people-business-conference-modern-classroom-daytime-1024x683.jpg\" alt=\"formarea profesional\u0103 2023\" width=\"1024\" height=\"683\" data-srcset=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/02\/everyone-is-smiling-listens-group-people-business-conference-modern-classroom-daytime-1024x683.jpg 1024w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/02\/everyone-is-smiling-listens-group-people-business-conference-modern-classroom-daytime-300x200.jpg 300w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/02\/everyone-is-smiling-listens-group-people-business-conference-modern-classroom-daytime-768x512.jpg 768w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/02\/everyone-is-smiling-listens-group-people-business-conference-modern-classroom-daytime-1536x1024.jpg 1536w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/02\/everyone-is-smiling-listens-group-people-business-conference-modern-classroom-daytime-2048x1365.jpg 2048w\" data-sizes=\"(max-width: 1024px) 100vw, 1024px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 1024px; --smush-placeholder-aspect-ratio: 1024\/683;\" \/><\/a><\/strong><\/h2>\n<h2 style=\"text-align: justify;\"><strong>Formarea profesional\u0103 poate fi f\u0103cut\u0103 \u0219i la nivel intern, \u00een cadrul companiei, nu doar de ter\u021bi<\/strong><\/h2>\n<p style=\"text-align: justify;\">Codul Muncii permite angaja\u021bilor \u0219i angajatorilor s\u0103 aleag\u0103 tipul de formare pe care ace\u0219tia s\u0103 \u00eel urmeze, doar c\u0103 formarea \u00een sensul cursurilor organizate de angajator nu se poate face \u00een orice condi\u021bii, respectiv, nu orice chestiune pe care angajatul o \u00eenva\u021b\u0103 \u00een firm\u0103 poate intra \u00een sfera form\u0103rii profesionale, a\u0219a cum e \u00een\u021beleas\u0103 \u00een Codul muncii \u0219i, astfel, angajatorul \u201es\u0103 bifeze\u201d cerin\u021ba form\u0103rii profesionale periodice. Dac\u0103 acesta \u00ee\u0219i dore\u0219te s\u0103 asigure formarea intern va trebui s\u0103 urm\u0103reasc\u0103 toate c\u0103ile legale, inclusiv autorizarea pentru formare.&nbsp;<\/p>\n<h2 style=\"text-align: justify;\"><strong>Clauza privind formarea profesional\u0103<\/strong><\/h2>\n<p style=\"text-align: justify;\">Angajatorii pot pretinde angaja\u021bilor \u00een care au investit sub aspectul form\u0103rii profesionale s\u0103 r\u0103m\u00e2n\u0103 \u00een companie o perioad\u0103 de timp, iar, dac\u0103 nu o fac, s\u0103 acopere cheltuielile de formare.<\/p>\n<p style=\"text-align: justify;\">Codul muncii stabile\u0219te c\u0103:<\/p>\n<ul style=\"text-align: justify;\">\n<li><strong>salaria\u021bii care au beneficiat<\/strong>&nbsp;de un curs sau un stagiu de formare profesional\u0103, la ini\u021biativa \u0219i pe cheltuiala angajatorului<strong>, nu pot avea ini\u021biativa \u00eencet\u0103rii contractului de munc\u0103 pentru o perioad\u0103 stabilit\u0103 prin act aditional<\/strong>, iar nerespectarea acestei obliga\u021bii determin\u0103 obligarea acestuia la suportarea tuturor cheltuielilor ocazionate de preg\u0103tirea sa profesional\u0103,&nbsp;<strong>propor\u021bional<\/strong> cu perioada nelucrat\u0103 din perioada stabilit\u0103 conform actului adi\u021bional la contractul individual de munc\u0103. Prevederea se aplic\u0103 inclusiv \u00een cazul celor concedia\u021bi disciplinar;<\/li>\n<li>durata obliga\u021biei salariatului de a presta munc\u0103 \u00een favoarea angajatorului care a suportat cheltuielile ocazionate de formarea profesional\u0103, precum \u0219i orice alte aspecte \u00een leg\u0103tur\u0103 cu obliga\u021biile salariatului, ulterioare form\u0103rii profesionale, se stabilesc prin act adi\u021bional la contractul de munc\u0103.<\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><strong>Regimul fiscal<\/strong><\/h2>\n<p style=\"text-align: justify;\">\u00cen exercitarea obliga\u021biei angajatorului de a asigura accesul angaja\u021bilor s\u0103i la formare profesional\u0103 periodic\u0103, <a href=\"https:\/\/www.anaf.ro\/anaf\/internet\/ANAF\/asistenta_contribuabili\/legislatie\/codul_fiscal\/\" target=\"_blank\" rel=\"noopener\">Codul fiscal<\/a> prevede un regim fiscal preferen\u021bial, aceste cheltuieli nefiind nici impozabile \u0219i nici nu intr\u0103 nici \u00een baza de calcul a contribu\u021biei de asigur\u0103ri sociale, nici \u00een a celei de asigur\u0103ri sociale de s\u0103n\u0103tate. Este obligatoriu, \u00eens\u0103, ca perfec\u021bionarea s\u0103 fie legat\u0103 de activitatea celui instruit, iar cheltuiala s\u0103 fie clar trecut\u0103 \u00een numele companiei.&nbsp;<\/p>\n<h2 style=\"text-align: justify;\"><strong>Angajatul\/angajata aflat\/\u0103 \u00een concediu de cre\u0219tere copil poate urma stagiile de formare profesional\u0103?<\/strong><\/h2>\n<p style=\"text-align: justify;\"><strong>Salaria\u021bii \u0219i-ar putea exercita dreptul de acces la formare profesional\u0103 \u0219i pe perioada suspend\u0103rii contractului individual de munc\u0103<\/strong><strong>,<\/strong> \u00eens\u0103 avem \u00een vedere acordul ini\u021bial al p\u0103r\u021bilor \u00een acest sens \u0219i este exclus\u0103 \u00eencheierea unui act adi\u021bional potrivit dispozi\u021biilor art. 198 din Codul muncii, fiind imposibil\u0103 modificarea unor clauze ale contractului individual atunci c\u00e2nd acesta este suspendat.
