Cum le abord\u0103m?"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/01\/two-men-pulling-rape.jpg\"><img decoding=\"async\" class=\"alignnone size-large wp-image-7327 lazyload\" data-src=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/01\/two-men-pulling-rape-1024x610.jpg\" alt=\"Conflictele de munc\u0103\" width=\"1024\" height=\"610\" data-srcset=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/01\/two-men-pulling-rape-1024x610.jpg 1024w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/01\/two-men-pulling-rape-300x179.jpg 300w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/01\/two-men-pulling-rape-768x458.jpg 768w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/01\/two-men-pulling-rape-1536x915.jpg 1536w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/01\/two-men-pulling-rape.jpg 1750w\" data-sizes=\"(max-width: 1024px) 100vw, 1024px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 1024px; --smush-placeholder-aspect-ratio: 1024\/610;\" \/><\/a><\/strong><\/p>\n<p style=\"text-align: justify;\">Indiferent de m\u0103surile pe care le lu\u0103m pentru a preveni conflictele la locul de munc\u0103, uneori acestea chiar nu pot fi evitate. \u00cen cele ce urmeaz\u0103 analiz\u0103m c\u00e2teva aspecte pe care le putem avea \u00een vedere pentru abordarea acestora.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Cadru legislativ<\/strong><\/h2>\n<p style=\"text-align: justify;\">Cadrul legislativ care reglementeaz\u0103 conflictele de munc\u0103 include articolele nr. 231-236 din Codul Muncii \u0219i Legea nr. 62\/2011 a dialogului social.<\/p>\n<ul style=\"text-align: justify;\">\n<li><a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/128647\">Codul Muncii<\/a> propune solu\u021bionarea amiabil\u0103 a conflictelor individuale de munc\u0103 \u0219i, potrivit prevederilor acestuia, \u00een contractul individual de munc\u0103 trebuie men\u021bionat faptul c\u0103 orice conflict de munc\u0103 se va solu\u021biona pe cale amiabil\u0103, prin conciliere.<\/li>\n<li><a href=\"http:\/\/www.mmuncii.ro\/j33\/images\/Documente\/Legislatie\/DialogSocial\/LegeaNr62din2011-LegeaDialoguluiSocial.pdf\">Legea nr. 62\/2011<\/a> a dialogului social con\u021bine prevederi legate de organizarea sindicatelor, negocierea contractului colectiv de munc\u0103, medierea \u0219i arbitrajul (articolele 175-180), conflictele colective de munc\u0103 unde angaja\u021bii vor fi sustinuti de sindicat, concilierea (articolele 166-174).<\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><strong>Concilierea conflictelor<\/strong><\/h2>\n<p style=\"text-align: justify;\">\u00cen data de 3 octombrie 2020 a intrat \u00een vigoare <a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocumentAfis\/230562\">Legea nr. 213\/2020<\/a> pentru modificarea \u0219i completarea Codului muncii, care aduce elemente de noutate \u00een privin\u021ba solu\u021bion\u0103rii amiabile a conflictelor individuale de munc\u0103 \u0219i organiz\u0103rii activit\u0103\u021bii de resurse umane \u0219i de salarizare.<\/p>\n<p style=\"text-align: justify;\">Actul normativ reglementeaz\u0103 concilierea ca o procedur\u0103&nbsp;<strong>facultativ\u0103&nbsp;<\/strong>preliminar\u0103 ce presupune \u00eencercarea solu\u021bion\u0103rii&nbsp;<strong>pe cale amiabil\u0103<\/strong>&nbsp;a diferendelor dintre angajatori \u0219i angaja\u021bi. Concilierea vizeaz\u0103&nbsp;<strong>conflictele individuale&nbsp;<\/strong>de munc\u0103, \u00een timp ce conflictele colective r\u0103m\u00e2n supuse modalit\u0103\u021bilor de solu\u021bionare prev\u0103zute de Legea dialogului social.<\/p>\n<p style=\"text-align: justify;\">Astfel, p\u0103r\u021bile&nbsp;<strong>vor putea<\/strong>&nbsp;cuprinde \u00een contractul individual de munc\u0103 (inclusiv prin acte adi\u021bionale) o clauz\u0103 prin care stabilesc c\u0103 orice conflict individual de munc\u0103 se solu\u021bioneaz\u0103 pe cale amiabil\u0103, prin procedura concilierii. Cu toate acestea, p\u0103r\u021bile vor putea renun\u021ba la conciliere \u00een cazul \u00een care nu se ajunge la o solu\u021bie care s\u0103 \u00eempace interesele ambelor p\u0103r\u021bi, caz \u00een care vor putea s\u0103 sesizeze instan\u021bele de judecat\u0103.<\/p>\n<p style=\"text-align: justify;\"><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/01\/angry-businesswoman-arguing-with-businessman.jpg\"><img decoding=\"async\" class=\"alignnone size-large wp-image-7326 lazyload\" data-src=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/01\/angry-businesswoman-arguing-with-businessman-1024x683.jpg\" alt=\"Conflictele de munc\u0103\" width=\"1024\" height=\"683\" data-srcset=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/01\/angry-businesswoman-arguing-with-businessman-1024x683.jpg 1024w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/01\/angry-businesswoman-arguing-with-businessman-300x200.jpg 300w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/01\/angry-businesswoman-arguing-with-businessman-768x512.jpg 768w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2023\/01\/angry-businesswoman-arguing-with-businessman.jpg 1368w\" data-sizes=\"(max-width: 1024px) 100vw, 1024px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 1024px; --smush-placeholder-aspect-ratio: 1024\/683;\" \/><\/a><\/p>\n<h2 style=\"text-align: justify;\"><strong>Cine poate media conflictul? <\/strong><\/h2>\n<p style=\"text-align: justify;\">Conform prevederilor Legii, oricare dintre p\u0103r\u021bi se va putea adresa unui&nbsp;<strong>consultant extern specializat \u00een legisla\u021bia muncii<\/strong>, respectiv&nbsp;<em>un avocat, un expert \u00een legisla\u021bia muncii sau, dup\u0103 caz, un mediator specializat \u00een legisla\u021bia muncii<\/em>.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Ce rol are consultantul extern?<\/strong><\/h2>\n<p style=\"text-align: justify;\">Consultantul extern&nbsp;\u201d<strong>va st\u0103rui ca p\u0103r\u021bile s\u0103 ac\u021bioneze responsabil pentru stingerea conflictului\u201d<\/strong>, cu respectarea drepturilor salaria\u021bilor. Astfel, acesta va \u00eencerca s\u0103 \u00eencurajeze p\u0103r\u021bile s\u0103 g\u0103seasc\u0103 de comun acord o solu\u021bie avantajoas\u0103 pentru fiecare dintre ele, \u00een vederea stingerii conflictului individual de munc\u0103.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Cine poate alege consultantul extern?<\/strong><\/h2>\n<p style=\"text-align: justify;\">P\u0103r\u021bile au dreptul s\u0103 \u00ee\u0219i&nbsp;<strong>aleag\u0103 \u00een mod liber<\/strong> consultantul extern, \u00eens\u0103 este necesar s\u0103 ajung\u0103 la un acord \u00een acest sens. \u00cen practic\u0103 se recomand\u0103 ca la \u00eencheierea contractului individual de munc\u0103, s\u0103 se stabileasc\u0103 \u0219i <strong>identitatea sau criteriile de identificare<\/strong>&nbsp;ale consultantului extern care va concilia p\u0103r\u021bile \u00een cazul unor conflicte individuale de munc\u0103, deoarece, \u00een momentul unui conflict, este probabil ca p\u0103r\u021bile s\u0103 ajung\u0103 destul de greu la un consens legat de alegerea unui mediator.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Deschiderea procedurii de consiliere<\/strong><\/h2>\n<p style=\"text-align: justify;\">Dup\u0103 alegerea consultantului extern, oricare dintre p\u0103r\u021bi poate transmite celeilalte invita\u021bia scris\u0103, prin mijloacele de comunicare prev\u0103zute \u00een contractul de munc\u0103. Procedura de conciliere poate debuta \u00een maximum cinci zile lucr\u0103toare de la transmiterea invita\u021biei. Este important de precizat faptul c\u0103, din momentul deschiderii procedurii, se va suspenda curgerea termenului \u00een care conflictul individual de munc\u0103 poate fi supus instan\u021bei de judecat\u0103.<\/p>\n<p style=\"text-align: justify;\">Procedura poate dura p\u00e2n\u0103 \u00een momentul \u00een care p\u0103r\u021bile au ajuns la un consens sau p\u00e2n\u0103 c\u00e2nd concilierea este declarat\u0103 e\u0219uat\u0103. Concilierea este finalizat\u0103 prin \u00eencheierea unui proces-verbal semnat de p\u0103r\u021bi \u0219i de consultantul extern. \u00cen document trebuie s\u0103 se men\u021bioneze concluzia procedurii de conciliere, respectiv dac\u0103 s-a ajuns la o &nbsp;\u00een\u021belegere sau se constat\u0103 e\u0219uarea concilierii sau neprezentarea uneia dintre p\u0103r\u021bi.<\/p>\n<p style=\"text-align: justify;\">\u00cen cazul \u00een care p\u0103r\u021bile ajung la o solu\u021bie par\u021bial\u0103 acest lucru va fi men\u021bionat \u00een procesul-verbal, iar restul diferendului dintre p\u0103r\u021bi va fi solu\u021bionat de c\u0103tre instan\u021b\u0103.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Regulamentul intern include \u00een mod obligatoriu procedura de solu\u021bionare pe cale amiabil\u0103 a conflictelor individuale de munc\u0103<\/strong><\/h2>\n<p style=\"text-align: justify;\">Este totodat\u0103 de punctat faptul c\u0103, potrivit <a href=\"https:\/\/www.codulmuncii.ro\/titlul_11\/capitolul_1_1.html\">Codului Muncii<\/a>, unul dintre elementele care trebuie s\u0103 fie incluse \u00een mod obligatoriu \u00een Regulamentul intern va fi&nbsp;\u201d<strong>procedura de solu<\/strong><strong>\u021b<\/strong><strong>ionare pe cale amiabil<\/strong><strong>\u0103<\/strong><strong> a conflictelor individuale de munc<\/strong><strong>\u0103<\/strong><strong>, a cererilor sau a reclama<\/strong><strong>\u021b<\/strong><strong>iilor individuale ale salaria<\/strong><strong>\u021b<\/strong><strong>ilor\u201d<\/strong>.<\/p>\n<p style=\"text-align: justify;\">&nbsp;<\/p>\n<p style=\"text-align: justify;\">&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Indiferent de m\u0103surile pe care le lu\u0103m pentru a preveni conflictele la locul de munc\u0103, uneori acestea chiar nu pot fi evitate. \u00cen cele ce urmeaz\u0103 analiz\u0103m c\u00e2teva aspecte pe care le putem avea \u00een vedere pentru abordarea acestora.
