Potrivit acestuia, actul adi\u021bional la contractul de munc\u0103 este un document care se \u00eencheie la apari\u021bia unei modific\u0103ri la unul dintre elementele obligatorii ale CIM (contractului individual de munc\u0103), \u00een timpul execut\u0103rii sale.<\/p>\n<h2><strong>C\u00e2nd se \u00eencheie actul adi\u021bional<\/strong><\/h2>\n<p>\u00cencheierea unui act adi\u021bional se realizeaz\u0103 obligatoriu&nbsp;anterior producerii oric\u0103rei modific\u0103ri, cu excep\u021bia situa\u021biilor \u00een care o asemenea modificare este prev\u0103zut\u0103 \u00een mod expres de lege sau \u00een contractul colectiv de munc\u0103 aplicabil.<\/p>\n<p>Actul adi\u021bional nu trebuie confundat cu anexa la contract. Diferenta major\u0103 dintre cele dou\u0103 este c\u0103 actul adi\u021bional se \u00eencheie cu acordul p\u0103r\u021bilor, atunci c\u00e2nd se modific\u0103 o prevedere din contract, \u00een timp ce anexa aduce complet\u0103ri contractului de munc\u0103, \u00eens\u0103 clauzele ini\u021biale r\u0103m\u00e2n neschimbate.<\/p>\n<p>Pentru contractul individual de munc\u0103, se pot realiza acte adi\u021bionale la modificarea normei de munc\u0103, prelungirea valabilit\u0103\u021bii contractului, timpul de odihn\u0103, schimbarea sediului unde salaria\u021bii \u00ee\u0219i desf\u0103\u0219oar\u0103 activitatea. Totodat\u0103, modificarea sporurilor sau alte schimb\u0103ri legate de func\u021bia sau sarcinile unui salariat \u0219i formarea profesional\u0103 vor necesita \u00eencheierea unui act adi\u021bional.<\/p>\n<p>Excep\u021bie fac modific\u0103rile aduse de o lege, asa cum este cazul cre\u0219terii salariului minim garantat, a c\u0103rui schimbare necesit\u0103 o Hot\u0103r\u00e2re de Guvern. \u00centr-un astfel de caz, nu este nevoie de un act adi\u021bional la contractul de munc\u0103. Tot ce mai r\u0103m\u00e2ne de f\u0103cut este refacerea \u0219tatelor de plat\u0103, iar noul salariu va fi comunicat \u00een urm\u0103toarele 20 de zile lucr\u0103toare \u00een Registrul Na\u021bional de Eviden\u021b\u0103 a Salaria\u021bilor.<\/p>\n<p>Modalitatea de informare asupra schimb\u0103rilor introduse prin actul adi\u021bional poate fi stabilit\u0103 \u0219i inclus\u0103 \u00een textul contractului individual de munc\u0103 sau printr-un document separat pentru informarea salaria\u021bilor.<\/p>\n<p>Este important s\u0103 preciz\u0103m c\u0103, \u00een acord cu Hot\u0103r\u00e2rea Guvernului nr. 500\/2011 privind Registrul General de Eviden\u021b\u0103 a Salaria\u021bilor, toate modific\u0103rile contractelor de munc\u0103 trebuie raportate \u00een REVISAL.
