{"id":7288,"date":"2022-11-18T23:05:33","date_gmt":"2022-11-18T21:05:33","guid":{"rendered":"https:\/\/www.lugera.ro\/blog\/?p=7288"},"modified":"2022-12-09T23:14:49","modified_gmt":"2022-12-09T21:14:49","slug":"documentele-angajare-ce-contine-dosarul-de-personal","status":"publish","type":"post","link":"https:\/\/www.lugera.ro\/blog\/documentele-angajare-ce-contine-dosarul-de-personal\/","title":{"rendered":"Documentele angajare \u2013 ce con\u021bine dosarul de personal?"},"content":{"rendered":"<p style=\"text-align: justify;\">\u00cen acord cu prevederile Codului Muncii, fiecare angajator are dreptul de a-\u0219i organiza activitatea de resurse umane \u0219i salarizare \u00een urm\u0103toarele moduri:<\/p>\n<ol style=\"text-align: justify;\">\n<li>prin asumarea de c\u0103tre angajator a atribu\u021biilor specifice;<\/li>\n<li>prin desemnarea unuia sau mai multor angaja\u021bi c\u0103rora s\u0103 le repartizeze, prin fi\u0219a postului, atribu\u021bii privind activitatea de resurse umane \u0219i salarizare;<\/li>\n<li>prin contractarea unor <a href=\"https:\/\/www.lugera.ro\/servicii\/payroll-si-administrare-personal\/\" target=\"_blank\" rel=\"noopener\">servicii externe specializate \u00een resurse umane \u0219i salarizare<\/a>.<\/li>\n<\/ol>\n<p style=\"text-align: justify;\">Rela\u021bia de angajare \u00eencepe odat\u0103 cu preg\u0103tirea contractului \u0219i se termin\u0103 cu transmiterea acestuia \u00een Revisal. Astfel, dup\u0103 ce recrutarea s-a \u00eencheiat, po\u021bi \u00eencepe demersurile pentru procedura de angajare a persoanei selectate. Iat\u0103 care sunt pa\u0219ii pe care trebuie s\u0103 \u00eei urma\u021bi \u00een procesul de angajare.<\/p>\n<h2 style=\"text-align: justify;\"><strong><em>Examenul de medicina muncii<\/em><\/strong><\/h2>\n<p style=\"text-align: justify;\">Dup\u0103 acceptarea ofertei, angajatul trebuie s\u0103 <a href=\"https:\/\/www.lugera.ro\/blog\/medicina-muncii-cand-are-loc-examenul-medical-la-angajare\/\" target=\"_blank\" rel=\"noopener\">efectueze examenul de medicina muncii.<\/a> Angajatorul este cel care se ocup\u0103 de programarea candidatului la clinica de medicina muncii cu care colaboreaz\u0103 \u0219i tot el este cel care va achita contravaloarea acestei consulta\u021bii. \u00cen urma acestei examin\u0103ri acesta va primi fi\u0219a de aptitudiuni \u00een care este precizat dac\u0103 angajatul este apt sau nu pentru jobul pentru care urmeaz\u0103 s\u0103 fie angajat.<\/p>\n<p style=\"text-align: justify;\">Este important s\u0103 preciz\u0103m faptul c\u0103 examenul medical la&nbsp;angajare este obligatoriu. \u00cen lipsa acestuia, contractul individual de munc\u0103 este nul.<\/p>\n<h2 style=\"text-align: justify;\"><strong><em>Semnarea contractului de munc\u0103 \u0219i transmiterea documentelor necesare la angajare<\/em><\/strong><\/h2>\n<p style=\"text-align: justify;\">Semnarea contractului de munc\u0103 este urm\u0103toarea etapa, iar \u00een acest moment viitorul angajat trebuie s\u0103 prezinte \u00een copie, urm\u0103toarele:<\/p>\n<ul style=\"text-align: justify;\">\n<li>Copie a buletinului\/ c\u0103r\u021bii de identitate\/ pa\u0219aportului sau dovada de reziden\u021b\u0103;<\/li>\n<li>Copii ale actelor de studii;<\/li>\n<li>Copii ale certificatelor de participare la cursurile de instruire sau perfec\u021bionare<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">La acestea se va ad\u0103uga Avizul medicului de medicina muncii (fi\u0219a de aptitudini).<\/p>\n<p style=\"text-align: justify;\">Documentele vor fi p\u0103strate de angajator \u00een dosarul de personal al salariatului al\u0103turi de contractul individual de munc\u0103 semnat de p\u0103r\u021bi \u0219i \u00eenregistrat \u00een <a href=\"https:\/\/www.lugera.ro\/blog\/revisal-care-sunt-termenele-de-transmitere-a-informatiilor-obligatorii\/\">REVISAL<\/a> p\u00e2n\u0103 cel t\u00e2rziu \u00een ziua anterioar\u0103 \u00eenceperii activit\u0103\u021bii de c\u0103tre persoana nou angajat\u0103.<\/p>\n<p style=\"text-align: justify;\">Angajatorul trebuie s\u0103 \u00eendeplineasc\u0103 \u0219i formalit\u0103\u021bile privind instructajul noului angajat \u00een privin\u021ba Securit\u0103\u021bii \u0219i S\u0103n\u0103t\u0103\u021bii \u00een Munc\u0103 (SSM), c\u00e2t \u0219i cel de Prevenire \u0219i Stingere a Incendiilor (PSI) \u00een primele zile de activitate. Pentru contractele de munc\u0103 temporar\u0103, Agentul de munc\u0103m temporar\u0103 va realiza instructajul general, iar utilizatorul, instructajul specific, la locul de munc\u0103.<\/p>\n<h2 style=\"text-align: justify;\"><strong><em>Alte documente care se pot ad\u0103uga dosarului de personal <\/em><\/strong><\/h2>\n<p style=\"text-align: justify;\">Angajatorul poate solicita \u0219i p\u0103stra la dosarul de personal \u0219i alte documente pe care le consider\u0103 importante pentru derularea raporturilor de munc\u0103, pentru certificarea legalit\u0103\u021bii \u0219i corectitudinii complet\u0103rii \u00een registru, dar \u0219i pentru calcularea salariului.<\/p>\n<ul style=\"text-align: justify;\">\n<li>Adeverinta medical\u0103 eliberat\u0103 de c\u0103tre medicul de familie al angajatului;<\/li>\n<li>Copii ale documentelor de studii;<\/li>\n<li>Certificatul de na\u0219tere;<\/li>\n<li>Certificatul de c\u0103s\u0103torie (dac\u0103 este cazul);<\/li>\n<li>Certificatul de nastere al copiilor;<\/li>\n<li>Hot\u0103r\u00e2rea de divort (dac\u0103 se aplic\u0103);<\/li>\n<li>Copie a carnetului de munc\u0103\/ copii ale adeverin\u021belor de la locurile de munc\u0103 anterioare (ex. decizia de \u00eencetare, adeverin\u021ba de vechime sau adeverin\u021ba cu stagiul de cotizare CAS etc.)<\/li>\n<li>Recomand\u0103ri de la locurile de munc\u0103 anterioare;<\/li>\n<li>Cazierul judiciar \u2013 Num\u0103rul&nbsp;<a href=\"https:\/\/www.lugera.ro\/jobex\/public\/ro\" target=\"_blank\" rel=\"noopener\">locurilor de munc\u0103&nbsp;<\/a>pentru care acesta este \u00eens\u0103 necesar a fost foarte mult redus. Va fi solicitat, \u00eens\u0103, pentru urm\u0103toarele posturi:\n<ul>\n<li>Avocati si consilieri juridici \u2013 nu trebuie s\u0103 fie condamna\u021bi pentru infrac\u021biuni care le afecteaz\u0103 profesia;<\/li>\n<li>Func\u021bionari publici \u2013 prin Hot\u0103r\u00e2rea de Guvern nr. 611\/2008;<\/li>\n<li>Gestionari \u2013 nu trebuie s\u0103 fie condamna\u021bi pentru fals, evaziune sau corup\u021bie;<\/li>\n<li>Paznici sau g\u0103rzi de corp;<\/li>\n<li>Medici\/farmaci\u0219ti\/denti\u0219ti \u2013 cazierul judiciar este necesar, potrivit legii nr. 95\/2006, pentru a deveni membru al unui colegiu.<\/li>\n<\/ul>\n<\/li>\n<li>Curriculum vitae, semnat \u0219i datat de c\u0103tre angajat; Conform HG 1.021\/2004, formatul de Curriculum Vitae va urm\u0103ri modelul comun european, iar acesta se anexeaz\u0103 la dosarul de personal datat \u0219i semnat de ambele p\u0103r\u021bi.<\/li>\n<li>Oferta de angajare;<\/li>\n<li>Fi\u0219a postului;<\/li>\n<li>Copie a livretului militar, dac\u0103 este cazul;<\/li>\n<li>Copie a permisului de conducere, dac\u0103 este cazul;<\/li>\n<li>Extrasul bancar pentru contul \u00een care se vireaz\u0103 salariul;<\/li>\n<li>Procese verbale de primire a bunurilor companiei (telefon mobil, laptop, automobil).<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">\u00cen cazul \u00een care angajatorul ofer\u0103 candida\u021bilor posibilitatea de a lucra \u00een regim de&nbsp;<strong><em>telemunc\u0103<\/em><\/strong>, aceasta trebuie stipulat\u0103 \u00eentr-un&nbsp;<strong><em>act aditional<\/em><\/strong>&nbsp;la contract.<\/p>\n<p style=\"text-align: justify;\">De asemenea, dosarul de angajare poate s\u0103 mai includ\u0103 \u0219i un act privind clauza de confiden\u021bialitate impus\u0103 de companie angajatului. Aceast\u0103 clauz\u0103 depinde foarte mult de func\u021bia pe care urmeaz\u0103 s\u0103 o ocupe angajatul \u00een cadrul companiei.<\/p>\n<h2 style=\"text-align: justify;\"><strong><em>Documentele care se semneaz\u0103 la data contractului de munc\u0103<\/em><\/strong><\/h2>\n<ul style=\"text-align: justify;\">\n<li>Acordul angajatului\/candidatului cu privire la procesarea datelor cu caracter personal;<\/li>\n<li>Declara\u021bia pe propria r\u0103spundere dat\u0103 de salariat privind luarea la cuno\u0219tin\u021b\u0103 a Regulamentului Intern al angajatorului;<\/li>\n<li>Declara\u021bia pe propria raspundere dat\u0103 de salariat privind locul func\u021biei de baz\u0103 \u0219i numele Casei de S\u0103n\u0103tate unde este \u00eenscris;<\/li>\n<li>Declara\u021bia pe propria r\u0103spundere dat\u0103 de salariat privind persoanele aflate \u00een \u00eentre\u021binerea sa pentru acordarea deducerii, precum \u0219i documentele justificative ale persoanelor luate \u00een \u00eentre\u021binere;<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Este obligatoriu ca la dosarul de personal s\u0103 existe&nbsp;<strong><em>fi\u0219a de post<\/em><\/strong>,&nbsp;<strong><em>oferta de angajare<\/em><\/strong>,&nbsp;<strong><em>acordul angajatului\/ candidatului cu privire la procesarea datelor cu caracter personal&nbsp;<\/em><\/strong>\u0219i&nbsp;<strong><em>declara\u021biile<\/em><\/strong>&nbsp;anterior men\u021bionate.<\/p>\n<h2 style=\"text-align: justify;\"><strong><em>Alte documente solicitate la angajare<\/em><\/strong><\/h2>\n<ul style=\"text-align: justify;\">\n<li>Pentru angaja\u021bii din institu\u0163iile din sistemul de \u00eenv\u0103\u0163\u0103m\u00e2nt, s\u0103n\u0103tate sau protec\u0163ie social\u0103, precum \u015fi orice entitate public\u0103 sau privat\u0103 a c\u0103rei activitate presupune contactul direct cu copii, persoane \u00een v\u00e2rst\u0103, persoane cu dizabilit\u0103\u0163i sau alte categorii de persoane vulnerabile angajatorii pot solicita Certificatul de Integritate comportamental\u0103. Trebuie s\u0103 subliniem faptul c\u0103 certificatul de integritate comportamental\u0103 nu se substituie&nbsp;certificatului de cazier judiciar.<\/li>\n<li>\u00cen cazul \u00een care candidatul a beneficiat de ajutor de somaj sau a fost \u00eenregistrat la Agen\u021bia Jude\u021bean\u0103 pentru Ocuparea For\u021bei de Munc\u0103 se poate solicita Reparti\u021bia AJOFM.<\/li>\n<li>Declaratia privind faptul c\u0103 nu s-au desf\u0103\u0219urat activit\u0103\u021bi de poli\u021bie politic\u0103, pentru cei care se angajeaz\u0103 \u00een jandarmerie, spre exemplu.<\/li>\n<li>Func\u021bionarii Publici vor completa declaratia privind conflictul de interese.<\/li>\n<li>Pentru domeniul medical sunt solicitate \u00eenainte de angajare avizul de liber\u0103 practic\u0103 \u0219i asigurarea de malpraxis, \u0219i, pentru medici, Certificatul de bun\u0103 practic\u0103 medical\u0103 eliberat de Colegiul medicilor.<\/li>\n<\/ul>\n<p style=\"text-align:
