{"id":7222,"date":"2022-10-08T11:47:33","date_gmt":"2022-10-08T08:47:33","guid":{"rendered":"https:\/\/www.lugera.ro\/blog\/?p=7222"},"modified":"2022-11-06T12:09:12","modified_gmt":"2022-11-06T10:09:12","slug":"demisia-formalitati-si-termene","status":"publish","type":"post","link":"https:\/\/www.lugera.ro\/blog\/demisia-formalitati-si-termene\/","title":{"rendered":"Demisia &#8211; Formalit\u0103\u021bi \u0219i termene"},"content":{"rendered":"<p style=\"text-align: justify;\">\u00cen cazul demisiilor, angajatorii trebuie \u0219tie c\u0103 au obliga\u021bia de a \u00eenregistra demisia, f\u0103c\u00e2nd precizarea dac\u0103 doresc sau nu ca angajatul s\u0103 r\u0103m\u00e2n\u0103 \u00een perioada de preaviz la munc\u0103, s\u0103 emit\u0103 decizia de constatare a \u00eencet\u0103rii raportului de munc\u0103 prin demisie \u0219i adeverin\u021ba de vechime pentru angajat, la finalul acestei perioade.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Angajatorul are obliga\u021bia de a \u00eenregistra Demisia \u00een Revisal<\/strong><\/h2>\n<p style=\"text-align: justify;\">Demisia este un act unilateral, o notificarea pe care angajatul o transmite,<strong>&nbsp;\u00een scris<\/strong>, angajatorului pentru a anun\u021ba \u00eencetarea raportului de munc\u0103. Demisia nu trebuie motivat\u0103 de c\u0103tre salariat \u0219i nu are nevoie de aprobarea angajatorului. Acesta din urm\u0103 are \u00eens\u0103 obliga\u021bia de a \u00eenregistra demisia \u00een registrul de intr\u0103ri-ie\u0219iri, precum \u0219i \u00eenregistrarea acesteia \u00een Registrul General de Eviden\u021b\u0103 a Salaria\u021bilor (REVISAL). Nerespectarea acestor prevederi poate poate fi sanc\u021bionat\u0103 de legiuitor cu amenzi cuprinse \u00eentre 1.500 \u0219i 3.000 lei pentru refuzul de a \u00eenregistra demisia \u0219i de a respecta termenele contractului individual de munc\u0103 \u00eencheiat cu salariatul, \u0219i cu amenzi \u00een valoare de p\u00e2n\u0103 la 8.000 de lei pentru ne\u00eenregistrarea demisiei \u00een Revisal.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Con\u021binutul demisiei<\/strong><\/h2>\n<p style=\"text-align: justify;\">Codul Muncii nu impune un anumit con\u021binut pentru demisie, fiind suficient ca aceasta s\u0103 fie scris\u0103. Distingem \u00eens\u0103 c\u00e2teva situa\u021bii:<\/p>\n<p style=\"text-align: justify;\"><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2022\/11\/model-cerere-demisie_cu-preaviz.docx\" target=\"_blank\" rel=\"noopener\"><strong>Demisie cu preaviz<\/strong><\/a>&nbsp;\u2013 aceasta con\u021bine \u00een\u0219tiin\u021barea c\u0103tre angajator privind \u00eencetarea contractului de munc\u0103 dup\u0103 termenul de preaviz stipulat \u00een acesta. Demisia trebuie s\u0103 con\u021bin\u0103, \u00een aceast\u0103 situa\u021bie, num\u0103rul de zile lucr\u0103toare ale preavizului. Solicitarea angajatului poate fi consemnat\u0103 \u0219i \u00eentr-un act denumit formular de demisie, care con\u021bine datele de identificare ale salariatului, func\u021bia ocupat\u0103 \u00een companie, durata preavizului \u0219i data la care \u00eenceteaz\u0103 contractul.<\/p>\n<p style=\"text-align: justify;\">\u201e<em>Termenul de preaviz este cel convenit de p\u0103r\u0163i \u00een contractul individual de munc\u0103 sau, dup\u0103 caz, cel prev\u0103zut \u00een contractele colective de munc\u0103 aplicabile \u015fi nu poate fi mai mare de 20 de zile lucr\u0103toare pentru salaria\u0163ii cu func\u0163ii de execu\u0163ie, respectiv mai mare de 45 de zile lucr\u0103toare pentru salaria\u0163ii care ocup\u0103 func\u0163ii de conducere<\/em>\u201d, prevede Codul Muncii.<\/p>\n<p style=\"text-align: justify;\"><strong><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2022\/11\/model-cerere-demisie-fara-preaviz.docx\" target=\"_blank\" rel=\"noopener\">Demisia f\u0103r\u0103 preaviz<\/a> &#8211; <\/strong>&nbsp;con\u021bine \u00een\u0219tiin\u021barea angajatorului referitoare la aceast\u0103 decizie a salariatului, decizie care trebuie argumentat\u0103 astfel \u00eenc\u00e2t s\u0103 reias\u0103 motivul pentru care angajatul nu respect\u0103 perioada de preaviz.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Demisia \u00een perioada de prob\u0103 <\/strong><\/h2>\n<p style=\"text-align: justify;\">\u00cen perioada de prob\u0103 nu exist\u0103 preaviz, iar contractul se poate termina printr-o simpl\u0103 notificare a oric\u0103reia dintre p\u0103r\u021bi c\u0103tre cealalt\u0103. Este important de men\u021bionat c\u0103&nbsp;<strong>dac\u0103 perioada de prob\u0103 nu este trecut\u0103 expres \u00een contract, regulile \u00eencet\u0103rii rela\u021biei de munc\u0103 f\u0103r\u0103 preaviz nu se pot<\/strong> aplica.<\/p>\n<h2 style=\"text-align: justify;\"><strong>C\u00e2nd consider\u0103m c\u0103 este ultima zi de munc\u0103 a angajatului?<\/strong>&nbsp;<\/h2>\n<p style=\"text-align: justify;\">\u201e<em>Contractul individual de munc\u0103 \u00eenceteaz\u0103&nbsp;<strong>la data expir\u0103rii termenului de preaviz&nbsp;<\/strong>sau la&nbsp;<strong>data renun\u0163\u0103rii totale ori par\u0163iale de c\u0103tre angajator la termenul respectiv<\/strong><\/em>\u201d, precizeaz\u0103 Codul Muncii<\/p>\n<p style=\"text-align: justify;\">Angajatorul nu decide c\u00e2nd anume se termin\u0103 raportul de munc\u0103, ci&nbsp;<strong>constat\u0103 \u00eencetarea<\/strong>&nbsp;acestuia (<strong>printr-o<\/strong>&nbsp;<strong>decizie de constatare<\/strong>), \u00een func\u021bie de una dintre situa\u021biile aplicabile: se parcurge perioada de preaviz, nu se parcurge total sau deloc, ori angajatul se afl\u0103 \u00een situa\u021bia \u00een care poate pleca f\u0103r\u0103 preaviz pentru c\u0103 se afl\u0103 \u00een una dintre situa\u021biile de mai jos:<\/p>\n<ul style=\"text-align: justify;\">\n<li>angajatorul nu respect\u0103 programul de lucru;<\/li>\n<li>angajatorul nu i-a acordat concediul de odihn\u0103;<\/li>\n<li>angajatorul nu a pl\u0103tit salariul la data stabilit\u0103.<\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><strong>Demisia nu trebuie confundat\u0103 cu \u00cencetarea contractului prin acordul p\u0103r\u021bilor<\/strong><\/h2>\n<p style=\"text-align: justify;\"><strong>Contractul individual de munc\u0103 poate \u00eenceta prin mai multe modalit\u0103\u0163i, \u00een acord cu art. 55 din Legea nr. 53\/2003 (<\/strong><a href=\"http:\/\/lege5.ro\/Gratuit\/gi2tknjxgq\/codul-muncii-din-2003\"><strong>Codul Muncii<\/strong><\/a><strong>): de drept, ca urmare a acordului p\u0103r\u0163ilor sau ca urmare a voin\u0163ei unilaterale a uneia dintre p\u0103r\u0163i.<\/strong><\/p>\n<p style=\"text-align: justify;\">\u00cencetarea contractului de munc\u0103 prin acordul p\u0103r\u0163ilor care are temeiul legal la&nbsp;<strong>art. 55<\/strong>&nbsp;lit. b din&nbsp;<a href=\"http:\/\/lege5.ro\/Gratuit\/gi2tknjxgq\/codul-muncii-din-2003\" target=\"_blank\" rel=\"noopener\">Codul Muncii<\/a>&nbsp;\u015fi este o modalitate simpl\u0103 \u015fi rapid\u0103 de a \u00eenceta un contract de munc\u0103 put\u00e2nd fi ini\u0163iat\u0103&nbsp;<strong>fie de salariat, fie de angajator<\/strong>. De cele mai multe ori, aceasta este ini\u0163iat\u0103 de c\u0103tre salariat printr-o simpl\u0103&nbsp;<strong>cerere<\/strong> adresat\u0103 angajatorului prin care solicit\u0103 \u00eencetarea contractului de munc\u0103 la o anumit\u0103 dat\u0103. Aceast\u0103 modalitate de \u00eencetare a contractutului de munc\u0103&nbsp;<strong>NU este afectat\u0103 de un termen de preaviz<\/strong> (ca \u00een cazul demisiei, concedierii pentru motive ce nu \u0163in de salariat), astfel contractul de munc\u0103 put\u00e2nd \u00eenceta chiar \u00een ziua urm\u0103toare sau peste \u015fase luni.<\/p>\n<p style=\"text-align: justify;\">Pentru a avea dovada \u00eenaint\u0103rii cererii de \u00eencetare a contractului de munc\u0103 prin acordul p\u0103r\u0163ilor cererea se redacteaz\u0103 \u00een dublu exemplar, un exemplar r\u0103m\u00e2ne la angajator, iar cel\u0103lalt exemplar la salariat, fiind \u00eenso\u021bit de un num\u0103r de \u00eenregistrare (din Registrul Societ\u0103\u0163ii), care face dovada f\u0103r\u0103 nicio \u00eendoial\u0103 c\u0103 acest document a fost depus la societate, precum \u015fi data la care s-a \u00eenaintat documentul.<\/p>\n<p style=\"text-align: justify;\"><strong>Un element-cheie<\/strong>&nbsp;al acestui tip de \u00eencetare a contractului de munc\u0103 este faptul c\u0103 angajatorul, fie prin reprezentantul legal, fie prin superiorul ierarhic al salariatului \u00een cauz\u0103, va scrie pe cerere men\u0163iunea&nbsp;<strong>\u201eDE ACORD\u201d<\/strong>, \u00eempreun\u0103 cu semn\u0103tura, numele s\u0103u \u00een clar \u015fi \u015ftampila societ\u0103\u0163ii. Doar prin acest mod se \u00eendepline\u015fte acordul de voin\u0163\u0103, esen\u0163ial \u00een cazul acestui tip de \u00eencetare a contractului de munc\u0103.
