Tat\u0103l salariat are dreptul la un concediu paternal de maximum 15 zile la na\u0219terea fiec\u0103rui copil."},"content":{"rendered":"<p style=\"text-align: justify;\"><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2022\/10\/family-spend-time-summer-garden-scaled.jpg\"><img decoding=\"async\" class=\"alignnone size-large wp-image-7188 lazyload\" data-src=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2022\/10\/family-spend-time-summer-garden-1024x683.jpg\" alt=\"concediu paternal\" width=\"1024\" height=\"683\" data-srcset=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2022\/10\/family-spend-time-summer-garden-1024x683.jpg 1024w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2022\/10\/family-spend-time-summer-garden-300x200.jpg 300w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2022\/10\/family-spend-time-summer-garden-768x512.jpg 768w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2022\/10\/family-spend-time-summer-garden-1536x1024.jpg 1536w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2022\/10\/family-spend-time-summer-garden-2048x1365.jpg 2048w\" data-sizes=\"(max-width: 1024px) 100vw, 1024px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 1024px; --smush-placeholder-aspect-ratio: 1024\/683;\" \/><\/a><\/p>\n<p style=\"text-align: justify;\">\u00cen data 26.08.2022 a fost aprobat\u0103 de Guvern Ordonan\u021ba de <a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/258699\">Urgen\u021b\u0103 117\/2022<\/a>, <strong>pentru modificarea \u015fi completarea Legii concediului paternal nr. 210\/1999. <\/strong>Ordonan\u021ba de Urgen\u021b\u0103 a fost adoptat\u0103 pentru transpunerea Directivei (UE) 2019\/1158 privind echilibrul dintre via\u021ba profesional \u0219i cea privat\u0103 a p\u0103rin\u021bilor \u0219i \u00eengrijitorilor \u0219i a fost publicat\u0103 \u00een Monitorul Oficial nr. 845 din 29 august 2022.<\/p>\n<p style=\"text-align: justify;\">Modific\u0103rile pe care aceasta le aduce Legii nr. 210\/1999 vizeaz\u0103 urm\u0103toarele aspecte:<\/p>\n<h2 style=\"text-align: justify;\"><strong>Scopul acord\u0103rii concediului paternal<\/strong><\/h2>\n<p style=\"text-align: justify;\">Acesta a fost completat cu obliga\u021bia de a facilita concilierea vie\u0163ii profesionale cu via\u0163a de familie \u00een cazul lucr\u0103torilor care sunt p\u0103rin\u0163i.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Cine beneficiaz\u0103 de concediu paternal?<\/strong><\/h2>\n<p style=\"text-align: justify;\">Potrivit actului normativ, persoana \u00eendrept\u0103\u021bit\u0103 s\u0103 beneficieze de concediu paternal este lucr\u0103torul.<\/p>\n<p style=\"text-align: justify;\">Acesta este definit ca fiind persoana care desf\u0103\u015foar\u0103 activitate \u00een baza unui contract de munc\u0103 sau a unui raport de serviciu, \u00eencheiate \u00een conformitate cu prevederile legale.<\/p>\n<p style=\"text-align: justify;\">Sunt asimila\u021bi totodat\u0103 lucr\u0103torilor:<\/p>\n<ul style=\"text-align: justify;\">\n<li>cei care desf\u0103\u015foar\u0103 activitate pe baza unor contracte din activitate sportive \u00een conformitate cu prevederile legale incidente;<\/li>\n<li>cei care desf\u0103\u015foar\u0103 activitate pe baza unor conven\u0163ii de munc\u0103 individuale \u00eencheiate potrivit Legii nr. 1\/2005 privind organizarea \u015fi func\u0163ionarea coopera\u0163iei, republicat\u0103, cu modific\u0103rile ulterioare;<\/li>\n<li>directorii care desf\u0103\u015foar\u0103 activitate pe baza contractelor de mandat \u00eencheiate potrivit Legii societ\u0103\u0163ilor nr. 31\/1990, republicat\u0103, cu modific\u0103rile \u015fi complet\u0103rile ulterioare;<\/li>\n<li>cei care desf\u0103\u015foar\u0103 activitate pe baza unor contracte de management \u00eencheiate potrivit Legii nr. 66\/1993 privind contractul de management;<\/li>\n<li>cei care desf\u0103\u015foar\u0103 activitate pe baza unor contracte de management \u015fi de administrare \u00eencheiate potrivit Legii nr. 95\/2006 privind reforma \u00een domeniul s\u0103n\u0103t\u0103\u0163ii, republicat\u0103, cu modific\u0103rile \u015fi complet\u0103rile ulterioare;<\/li>\n<li>cei care ocup\u0103 o func\u0163ie de demnitate public\u0103.<\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><strong>Este eliminat\u0103 obliga\u021bia asigur\u0103rii sociale de stat.<\/strong><\/h2>\n<p style=\"text-align: justify;\">Actul normativ elimin\u0103 cerin\u021ba ca tat\u0103l nou-n\u0103scutului s\u0103 fie asigurat \u00een cadrul sistemului asigur\u0103rilor sociale de stat pentru a putea beneficia de dreptul la concediu paternal pl\u0103tit. A\u0219adar, este suficient ca tat\u0103l s\u0103 aib\u0103 calitatea de lucr\u0103tor, respectiv de persoan\u0103 asimilat\u0103 lucr\u0103torului \u00een sensul Legii nr. 210\/1999.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Durata concediului paternal este extins\u0103 <\/strong><\/h2>\n<p style=\"text-align: justify;\">Concediul paternal a fost extins de la 5 zile lucr\u0103toare la 10 zile lucr\u0103toare. Mai mult, \u00een cazul tat\u0103lui care \u00eendepline\u015fte obligatoriu serviciul militar \u00een calitate de militar \u00een termen, potrivit legii, are dreptul la o permisie de 10 zile lucr\u0103toare acordate la na\u015fterea propriului copil. \u00cenainte, acesta avea dreptul la o permisie de doar 7 zile calendaristice.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Ta\u021bii care urmeaz\u0103 cursul de puericultur\u0103 beneficiaz\u0103 de 5 zile libere pentru fiecare copil nou-n\u0103scut, indiferent de data ob\u021binerii certificatului<\/strong><\/h2>\n<p style=\"text-align: justify;\">Ta\u021bii care au ob\u021binut atestatul de absolvire a cursului de puericultur\u0103 vor avea o durat\u0103 concediului extins\u0103 cu 5 zile lucr\u0103toare. Este, astfel, recunoscut\u0103 posibilitatea extinderii concediului paternal \u00een baza atestatului de absolvire a cursului de puericultur\u0103, indiferent de data la care acesta este ob\u021binut, pentru fiecare copil nou-n\u0103scut.<\/p>\n<h2 style=\"text-align: justify;\"><strong><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2022\/10\/concediu-paternal-1.jpg\"><img decoding=\"async\" class=\"alignnone size-large wp-image-7189 lazyload\" data-src=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2022\/10\/concediu-paternal-1-1024x683.jpg\" alt=\"concediu paternal 1\" width=\"1024\" height=\"683\" data-srcset=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2022\/10\/concediu-paternal-1-1024x683.jpg 1024w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2022\/10\/concediu-paternal-1-300x200.jpg 300w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2022\/10\/concediu-paternal-1-768x512.jpg 768w, https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2022\/10\/concediu-paternal-1.jpg 1440w\" data-sizes=\"(max-width: 1024px) 100vw, 1024px\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 1024px; --smush-placeholder-aspect-ratio: 1024\/683;\" \/><\/a><\/strong><\/h2>\n<h2 style=\"text-align: justify;\"><strong>Concediul paternal este considerat vechime \u00een munc\u0103<\/strong><\/h2>\n<p style=\"text-align: justify;\">Ordonan\u021ba introduce un nou alineat al articolului 2 din Legea nr. 210\/1999 care stabile\u0219te c\u0103 \u201dperioada concediului paternal constituie vechime \u00een munc\u0103 \u015fi \u00een serviciu, precum \u015fi \u00een specialitate \u015fi se are \u00een vedere la stabilirea drepturilor ce se acord\u0103 \u00een raport cu acestea\u201d.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Concediul paternal este pl<\/strong><strong>\u0103tit din fondul de salarii al angajatorului<\/strong><\/h2>\n<p style=\"text-align: justify;\"><strong><em>Conform <\/em><\/strong><a href=\"https:\/\/lege5.ro\/gratuit\/gezdkmjyg44ti\/ordonanta-de-urgenta-nr-117-2022-pentru-modificarea-si-completarea-legii-concediului-paternal-nr-210-1999\"><strong><em>Ordonan\u021bei<\/em><\/strong><\/a><strong><em> \u201d<\/em><\/strong><em>&nbsp;Indemniza\u0163ia pentru concediul paternal se pl\u0103te\u015fte din fondul de salarii al angajatorului \u015fi este egal\u0103 cu salariul corespunz\u0103tor perioadei respective.&#8221;<\/em><\/p>\n<h2 style=\"text-align: justify;\"><strong>Angajatorul este obligat s\u0103 aprobe concediul paternal<\/strong><\/h2>\n<p style=\"text-align: justify;\">Ordonan\u021ba de <a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/258699\">Urgen\u021b\u0103 117\/2022<\/a> prevede \u00een mod expres obliga\u021bia angajatorului de a aproba concediul paternal, dar \u0219i de a informa salaria\u021bii cu privire la dreptul la acest tip de concediu \u0219i la indemniza\u021bia aferent\u0103. Nerespectarea acestei prevederi este sanc\u021bionat\u0103 cu amend\u0103 de la 4000 la 8000 de lei \u0219i este considerat\u0103 contraven\u021bie. Amenda se aplic\u0103 doar angajatorilor persoane juridice.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Protec\u021bie<\/strong><\/h2>\n<p style=\"text-align: justify;\"><strong>Salaria\u021bii afla\u021bi \u00een concediu paternal&nbsp;nu pot fi concedia\u021bi<\/strong>, situa\u021bie similar\u0103 celor afla\u021bi \u00een concediul de cre\u0219tere a copilului sau \u00een plata stimulentului de inser\u021bie, \u00eens\u0103, la fel ca \u0219i \u00een cazul ultimelor dou\u0103 exemple, interdic\u021bia nu se aplic\u0103 \u00een cazul reorganiz\u0103rii judiciare sau a falimentului angajatorului. Firmele care ac\u021bioneaz\u0103 contrar acestei interdic\u021bii risc\u0103 amenzi cuprinse \u00eentre 3.000 \u0219i 10.000 lei.<\/p>\n<p style=\"text-align: justify;\"><strong>Tratamentul discriminatoriu<\/strong>&nbsp;fa\u021b\u0103 de un salariat care s-a aflat \u00een concediu paternal este, de asemenea,&nbsp;<strong>sanc\u021bionabil cu amenzi \u00eentre 3.000 \u0219i 10.000 lei<\/strong>. Au fost introduse aceste amenzi pentru \u00eenc\u0103lcarea obliga\u021biei de a primi lucr\u0103torul la ultimul loc de munc\u0103 sau unul echivalent dup\u0103 terminarea concediului sau dac\u0103 salariatului care a solicitat sau efectuat acest concediu i se aplic\u0103 un tratament mai pu\u021bin favorabil.&nbsp;<\/p>\n<h2 style=\"text-align: justify;\"><strong>Drepturi egale<\/strong><\/h2>\n<p style=\"text-align: justify;\">Prin Ordonan\u021ba de <a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/258699\">Urgen\u021b\u0103 117\/2022<\/a> s-a urm\u0103rit oferirea unor drepturi ta\u021bilor care beneficiaz\u0103 de concediu paternal \u00een oglind\u0103 cu cele de care beneficiaz\u0103 salariatele \u00eens\u0103rcinate sau care au n\u0103scut recent \u00een baza Legii nr. 202\/2002 privind egalitatea de \u015fanse \u015fi de tratament \u00eentre femei \u015fi b\u0103rba\u0163i, republicat\u0103, cu modific\u0103rile \u015fi complet\u0103rile ulterioare. Astfel, lucr\u0103torii care beneficiaz\u0103 de concediu paternal trebuie s\u0103 beneficieze \u0219i de condi\u0163ii care nu le sunt mai pu\u0163in favorabile, precum \u015fi de orice \u00eembun\u0103t\u0103\u0163ire a condi\u0163iilor de munc\u0103 la care ar fi avut dreptul dac\u0103 nu ar fi efectuat acest concediu.<\/p>\n<p style=\"text-align: justify;\">Este important s\u0103 punct\u0103m o serie de aspecte care au r\u0103mas valabile \u0219i dup\u0103 modific\u0103rile aduse legisla\u021biei:<\/p>\n<ul>\n<li style=\"text-align: justify;\">concediul paternal se acord\u0103 doar dac\u0103 salariatul depune o cerere \u00een acest sens \u0219i doar \u00een perioada de opt s\u0103pt\u0103m\u00e2ni de la na\u0219terea copilului;<\/li>\n<li style=\"text-align: justify;\">cererea trebuie justificat\u0103 de certificatul de na\u0219tere al copilului din care s\u0103 reias\u0103 calitatea de tat\u0103 a lucr\u0103torului;<\/li>\n<li style=\"text-align: justify;\">concediu paternal este suportat integral din fondurile de salarii ale companiei, iar indemniza\u021bia este egal\u0103 cu salariul pentru 15 zile;<\/li>\n<li style=\"text-align: justify;\">zilele de concediu paternal nu se scad din concediul de odihn\u0103 \u0219i un afecteaz\u0103 dreptul la concediul de odihn\u0103 al lucr\u0103torului.<\/li>\n<\/ul>\n<p>Photo credit &#8211; www.freepik.com<\/p>\n","protected":false},"excerpt":{"rendered":"<p>\u00cen data 26.08.2022 a fost aprobat\u0103 de Guvern Ordonan\u021ba de Urgen\u021b\u0103 117\/2022, pentru modificarea \u015fi completarea Legii concediului paternal nr. 210\/1999.
