{"id":7176,"date":"2022-09-23T20:13:29","date_gmt":"2022-09-23T17:13:29","guid":{"rendered":"https:\/\/www.lugera.ro\/blog\/?p=7176"},"modified":"2022-09-26T21:19:37","modified_gmt":"2022-09-26T18:19:37","slug":"18-lucruri-pe-care-trebuie-sa-le-cunoasteti-despre-tichetele-de-masa","status":"publish","type":"post","link":"https:\/\/www.lugera.ro\/blog\/18-lucruri-pe-care-trebuie-sa-le-cunoasteti-despre-tichetele-de-masa\/","title":{"rendered":"18 lucruri pe care trebuie s\u0103 le cunoa\u0219te\u021bi despre tichetele de mas\u0103"},"content":{"rendered":"<p>Tichetele de mas\u0103 sunt <strong>bilete de valoare<\/strong>, pe care orice angajator le poate acorda lunar salaria\u021bilor s\u0103i, \u00een baza&nbsp;<em><a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/202623\">Legii nr. 165\/2018<\/a><\/em><em>&nbsp;privind acordarea biletelor de valoare<\/em>, iar acestea pot fi utilizate exclusiv pentru achitarea mesei sau achizi\u021bionarea de produse alimentare.<\/p>\n<p>Aceste beneficii sunt folosite adesea de angajatori pentru c\u0103 presupun o sarcin\u0103 fiscal\u0103 mai sc\u0103zut\u0103, av\u00e2nd \u00een vedere faptul c\u0103 pentru tichetele de mas\u0103 nu se pl\u0103tesc contribu\u021bii sociale, a\u0219a cum se \u00eent\u00e2mpl\u0103 \u00een cazul salariilor.&nbsp;<\/p>\n<p>Am pus laolalt\u0103 c\u00e2teva dintre cele mai importante aspecte de re\u021binut cu privire la tichetele de mas\u0103, pe care le pute\u021bi consulta mai jos:<\/p>\n<ol>\n<li><strong>Salaria\u021bii pot beneficia de cel mult un tichet de mas\u0103 pentru fiecare zi lucr\u0103toare<\/strong>din luna pentru care se efectueaz\u0103 distribuirea\/ transferul valorii nominale a tichetelor de mas\u0103, dup\u0103 caz.&nbsp;<\/li>\n<li><strong>Nu se consider\u0103 zile lucrate perioadele \u00een care salaria\u021bii:<\/strong><\/li>\n<\/ol>\n<ul>\n<li>efectueaz\u0103 concediul de odihn\u0103;<\/li>\n<li>beneficiaz\u0103 de zile libere pl\u0103tite, \u00een cazul unor evenimente familiale deosebite;<\/li>\n<li>beneficiaz\u0103 de alte zile libere acordate conform legii sau contractelor colective de munc\u0103;<\/li>\n<li>sunt delega\u021bi sau deta\u0219a\u021bi \u00een afara localit\u0103\u021bii \u00een care \u00ee\u0219i au locul permanent de munc\u0103 \u0219i primesc indemniza\u021bie de delegare sau de deta\u0219are;<\/li>\n<li>se afl\u0103 \u00een concediu pentru incapacitate temporar\u0103 de munc\u0103;<\/li>\n<li>sunt absen\u021bi de la locul de munc\u0103 ori se afl\u0103 \u00een alte situa\u021bii stabilite de angajator \u00eempreun\u0103 cu organiza\u021biile sindicale ori, dup\u0103 caz, cu reprezentan\u021bii salaria\u021bilor<\/li>\n<\/ul>\n<p><strong>3. Acordarea tichetelor de mas\u0103 trebuie stabilit\u0103 cu acordul p\u0103r\u021bilor<\/strong><\/p>\n<p><strong>4. Tichetele de mas\u0103 nu pot fi incluse \u00een minimul cu care trebuie s\u0103 fie pl\u0103tit un angajat<\/strong>. Aceasta \u00eenseamn\u0103 c\u0103, dac\u0103 un angajat e pl\u0103tit cu salariul minim pe economie, \u00een acest minim nu pot fi incluse tichetele de mas\u0103. Acordarea lor \u00eensemna un plus la salariul minim.<\/p>\n<p><strong>5. Valoarea nominal\u0103 a unui tichet de mas\u0103 urc\u0103 de la 1 iunie la 30 lei<\/strong>. Aceasta \u00eenseamn\u0103 c\u0103 un tichet de mas\u0103 (pe zi) nu poate dep\u0103\u0219i aceast\u0103 sum\u0103, dar poate fi mai mic de at\u00e2t ca valoare, \u00een func\u021bie de cum decide angajatorul. Cre\u0219terea valorii nominale maxime a unui tichet de mas\u0103 de la 20 de lei la 30 de lei se aplic\u0103, \u00eencep\u00e2nd cu 1 iulie 2022, \u0219i \u00een semestrul al doilea al anului 2022, precum \u0219i \u00een primele dou\u0103 luni ale semestrului I al anului 2023, respectiv februarie \u0219i martie 2023. Angajatorii au putut acorda suplimentar, \u00een luna iulie 2022, tichete de mas\u0103 av\u00e2nd valoarea corespunz\u0103toare diferen\u021bei dintre valoarea stabilit\u0103 de p\u00e2n\u0103 la 30 RON\/tichet de mas\u0103\/zi, \u0219i valoarea acordat\u0103 \u00een luna iunie 2022 corespunz\u0103tor zilelor lucrate \u00een aceast\u0103 lun\u0103;<\/p>\n<p>6. Acordarea tichetelor de mas\u0103 se poate face <strong>at\u00e2t \u00een cazul angaja\u021bilor cu norm\u0103 \u00eentreag\u0103,&nbsp;<u>c\u00e2t \u0219i \u00een cazul celor cu norm\u0103 par\u021bial\u0103<\/u><\/strong>, cu condi\u021bia ca ace\u0219tia s\u0103 aib\u0103<strong> func\u021bia de baz\u0103 la firma respectiv\u0103<\/strong>. Stabilirea func\u021biei de baz\u0103 se aplic\u0103 \u0219i \u00een cazul salaria\u021bilor care au mai multe contracte de munc\u0103 sau chiar mai multe func\u021bii \u00een cadrul aceleia\u0219i firme, deoarece salariatul nu poate primi tichete de mas\u0103 din mai multe locuri de munc\u0103.&nbsp;<\/p>\n<p><strong>\u00cen cazul \u00een care nu se poate stabili func\u021bia de baz\u0103,<\/strong>&nbsp;salariatul alege, \u00een scris, angajatorul care \u00eei va acorda biletele de valoare, av\u00e2nd obliga\u021bia de a transmite, \u00een termen de maximum 10 zile lucr\u0103toare, \u0219i c\u0103tre ceilal\u021bi angajatori op\u021biunea realizat\u0103.&nbsp;<\/p>\n<p><em>\u201cSalaria\u021bii beneficiaz\u0103 lunar de un num\u0103r de tichete de mas\u0103 cel mult egal cu num\u0103rul de zile lucrate, iar acest num\u0103r nu poate dep\u0103\u0219i num\u0103rul de zile lucr\u0103toare din luna pentru care se acord\u0103 tichetele\u201d<\/em><em>, conform HG 1.045\/2018.&nbsp;<\/em><em>Astfel, indiferent dac\u0103 ziua de lucru este de 8 sau de 2 ore, angajatul poate beneficia de tichete de mas\u0103 pentru fiecare zi lucrat\u0103. <\/em><\/p>\n<ol start=\"7\">\n<li><strong>Legea nu obliga angajatorii s\u0103 acorde tichete de mas\u0103<\/strong>, deci dac\u0103 posibilitatea financiar\u0103 a angajatorului nu (mai) permite acordarea acestora, tichetele de mas\u0103 nu vor (mai) fi acordate.<\/li>\n<li><strong>Tichetele de mas\u0103 nu se cuprind \u00een baza de calcul a contribu\u021biilor sociale obligatorii<\/strong><strong>,<\/strong>iar acordarea acestora reduce cu aproximativ 37% efortul financiar raportat la valoarea acestora.<\/li>\n<li><strong>Bugetarii nu au dreptul la tichete de mas\u0103 dac\u0103 primesc alte indemniza\u021bii similare.<\/strong> \u00cen primul r\u00e2nd, tichetele de mas\u0103<strong>nu&nbsp;pot fi acordate salaria\u021bilor care beneficiaz\u0103 de indemniza\u021bie de hran\u0103<\/strong><strong>, <\/strong>conform dispozi\u021biilor <a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/190446\">Legii 153\/2017<\/a> <strong>sau drepturi de hran\u0103 pentru personalul din sectorul de ap\u0103rare na\u021bional\u0103, ordine public\u0103 \u0219i siguran\u021b\u0103 na\u021bional\u0103<\/strong><strong>.<\/strong><\/li>\n<li><strong>De la 1 februarie 2022 tichetele de mas\u0103 pot fi pl\u0103tite doar pe card, <\/strong>nu \u0219i sub form\u0103 de tichete tip\u0103rite. Tichetele tip\u0103rite vor putea fi folosite, \u00een continuare,&nbsp;<strong>p\u00e2n\u0103 la data expir\u0103rii lor<\/strong>.<\/li>\n<\/ol>\n<p>Valoarea tichetelor de mas\u0103&nbsp;<strong>pe suport electronic&nbsp;<\/strong>este transferat\u0103 lunar salaria\u021bilor, \u00een ultima decad\u0103 a fiec\u0103rei luni, pentru luna urm\u0103toare, corespunz\u0103tor num\u0103rului de zile lucr\u0103toare din luna pentru care se face transferul.<\/p>\n<p>\u00cen ambele situa\u021bii salaria\u021bilor li se acord\u0103 tichetele de mas\u0103 anterior presta\u021biei, \u00eens\u0103 ace\u0219tia pot primi lunar un num\u0103r de tichete de mas\u0103 cel mult egal cu num\u0103rul de zile lucrate.<\/p>\n<ol start=\"11\">\n<li>Salariatul are&nbsp;<strong>obliga\u021bia s\u0103 restituie angajatorului<\/strong>,&nbsp;la finele fiec\u0103rei luni, precum \u0219i la \u00eencetarea contractului individual de munc\u0103,valoarea corespunz\u0103toare tichetelor de mas\u0103 necuvenite.<\/li>\n<li><strong>Dac\u0103 programul de lucru al unui salariat dep\u0103\u0219e\u0219te normalul de 8 ore pe zi<\/strong>, num\u0103rul de tichete de mas\u0103 pe care le prime\u0219te se calculeaz\u0103 prin \u00eemp\u0103r\u021birea num\u0103rului de ore \u00een care salariatul a fost prezent la lucru la durata normal\u0103 a timpului de munc\u0103 de 8 ore. Frac\u021biile rezultate din calcul se consider\u0103 zi de prezen\u021b\u0103 la lucru, cu condi\u021bia ca totalul zilelor s\u0103 nu dep\u0103\u0219easc\u0103 num\u0103rul de zile lucr\u0103toare din luna pentru care se acord\u0103 tichetele.<\/li>\n<li><strong>Telesalaria\u021bii \u0219i angaja\u021bii care lucreaz\u0103 de la domiciliu beneficiaz\u0103 la r\u00e2ndul lor de tichete de mas\u0103<\/strong>.&nbsp;\u00cen acord cu <em>Legea nr. 81\/2018 privind reglementarea activit\u0103\u021bii de telemunc\u0103<\/em><strong>\u201d Telesalariatul beneficiaz\u0103 de toate drepturile recunoscute<\/strong>prin lege, prin regulamentele interne \u0219i contractele colective de munc\u0103&nbsp;<strong>aplicabile salaria\u021bilor care au locul de munc\u0103 la sediul sau domiciliul angajatorului.\u201d <\/strong>Aceasta \u00eensemn\u0103&nbsp;<strong>\u0219i dreptul la tichete de mas\u0103, dac\u0103 angajatorul respectiv le acord\u0103 \u00een mod obi\u0219nuit<\/strong>.<\/li>\n<li><strong>Salaria\u021bii afla\u021bi \u00een perioada de prob\u0103 \u0219i cei care au \u00eencheiat un contract pe perioad\u0103 determinat\u0103&nbsp;<\/strong>beneficiaz\u0103 de tichete de mas\u0103 dac\u0103 angajatorul le acord\u0103 salaria\u021bilor care fac parte din aceea\u0219i categorie, \u00een acelea\u0219i condi\u021bii.<\/li>\n<li>De\u0219i <strong>tichetele de mas\u0103<\/strong> sunt asimilate veniturilor din salarii, acestea <strong>nu pot fi executate silit<\/strong> deoarece sunt acordate angaja\u0163ilor lunar, ca aloca\u0163ie individual\u0103 de hran\u0103, urm\u00e2nd a fi utilizate numai pentru achitarea mesei sau pentru achizi\u0163ionarea de produse&nbsp;alimentare.<\/li>\n<li><strong>Angajatorul <\/strong>este cel care <strong>re\u021bine<\/strong> din salariul angajatului <strong>\u0219i achit\u0103 impozitul pe venit<\/strong> pentru suma acordat\u0103.<\/li>\n<li>Toate biletele de valoare, deci \u0219i <strong>tichetele de mas\u0103<\/strong>, <strong>pot fi utilizate doar pe teritoriul Rom\u00e2niei<\/strong>,&nbsp;<strong>\u00een termenul de valabilitate<\/strong>\u0219i numai pentru achizi\u021bionarea bunurilor \u0219i serviciilor pentru care au fost emise.<\/li>\n<\/ol>\n<p><strong>Tichetele de mas\u0103 sunt valabile<\/strong>, dup\u0103 cum e prev\u0103zut \u00een&nbsp;<a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/209698\"><em>HG 1.045\/2018<\/em><\/a><em>&nbsp;pentru aprobarea Normelor metodologice de aplicare a Legii nr. 165\/2018<\/em>,&nbsp;<strong>\u00een anul calendaristic \u00een care au fost emise<\/strong>, cu excep\u021bia tichetelor emise \u00een perioada 1 noiembrie &#8211; 31 decembrie, care pot fi utilizate p\u00e2n\u0103 la data de&nbsp;<strong>31 decembrie a anului urm\u0103tor<\/strong>.<\/p>\n<p>\u00cen cazul \u00een care sumele primite pe card ca tichete de mas\u0103 nu sunt folosite \u00een perioadele de valabilitate amintite, ele nu se mai pot folosi, fiind anulate.<\/p>\n<ol start=\"18\">\n<li><strong>Pentru contractul de mandat \u0219i administratori nu se pot acorda de tichete de mas\u0103<\/strong>. <a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/202623\">Legea nr. 165\/2018 privind biletele de valoare<\/a> se refer\u0103 \u00een mod exclusiv la angaja\u021bi \u0219i la contracte de munc\u0103.<\/li>\n<\/ol>\n","protected":false},"excerpt":{"rendered":"<p>Tichetele de mas\u0103 sunt bilete de valoare, pe care orice angajator le poate acorda lunar salaria\u021bilor s\u0103i, \u00een baza&nbsp;Legii nr. 165\/2018&nbsp;privind acordarea biletelor de valoare, iar acestea pot fi utilizate exclusiv pentru achitarea mesei sau achizi\u021bionarea de produse alimentare.
