De aici apare, \u00een mod firesc, \u00eentrebarea: simpla existen\u021b\u0103 a unui mandat de administrator poate conduce la pierderea indemniza\u021biei?<\/p>\n<p>R\u0103spunsul este nu.<\/p>\n<p>Din perspectiva <a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/124331\" target=\"_blank\" rel=\"noopener\"><strong>OUG nr. 111\/2010<\/strong><\/a>, problema nu este calitatea de administrator \u00een sine, ci existen\u021ba unor venituri ob\u021binute ca urmare a desf\u0103\u0219ur\u0103rii efective a unei activit\u0103\u021bi.<\/p>\n<h2>Ce urm\u0103re\u0219te, de fapt, legisla\u021bia privind concediul pentru cre\u0219terea copilului<\/h2>\n<p>Concediul pentru cre\u0219terea copilului are ca scop suspendarea sau reducerea activit\u0103\u021bii profesionale a p\u0103rintelui pentru a permite \u00eengrijirea copilului \u00een primii ani de via\u021b\u0103.<\/p>\n<p>Din acest motiv, legea stabile\u0219te anumite limit\u0103ri privind veniturile care pot fi realizate \u00een perioada \u00een care se acord\u0103 indemniza\u021bia.<\/p>\n<p>Totu\u0219i, legisla\u021bia nu interzice orice form\u0103 de venit.<\/p>\n<p>Diferen\u021ba esen\u021bial\u0103 este \u00eentre veniturile ob\u021binute ca urmare a unei activit\u0103\u021bi efective \u0219i veniturile pasive, care nu presupun prestarea unei activit\u0103\u021bi curente.<\/p>\n<p>Aceast\u0103 distinc\u021bie este important\u0103 at\u00e2t pentru beneficiari, c\u00e2t \u0219i pentru speciali\u0219tii HR \u0219i payroll care gestioneaz\u0103 astfel de situa\u021bii.<\/p>\n<h2>Ce venituri pot fi ob\u021binute f\u0103r\u0103 pierderea indemniza\u021biei<\/h2>\n<p>Potrivit legisla\u021biei \u00een vigoare, beneficiarii indemniza\u021biei de cre\u0219tere a copilului pot realiza anumite venituri f\u0103r\u0103 suspendarea dreptului.<\/p>\n<p>Printre acestea se num\u0103r\u0103:<\/p>\n<ul>\n<li>sume acordate \u00een baza contractului individual sau colectiv de munc\u0103, care nu sunt rezultatul desf\u0103\u0219ur\u0103rii efective a unei activit\u0103\u021bi \u00een perioada concediului;<\/li>\n<li>indemniza\u021biile primite pentru exercitarea func\u021biei de consilier local sau consilier jude\u021bean;<\/li>\n<li>venituri ob\u021binute din activit\u0103\u021bi desf\u0103\u0219urate efectiv, \u00een limita plafonului anual permis de lege.<\/li>\n<\/ul>\n<p>Pentru anul 2026, plafonul maxim al veniturilor realizate din activit\u0103\u021bi efective este de 13.208 lei net pe an, reprezent\u00e2nd de opt ori cuantumul minim al indemniza\u021biei pentru cre\u0219terea copilului.<\/p>\n<p>Dep\u0103\u0219irea acestui plafon poate conduce la suspendarea dreptului la indemniza\u021bie.<\/p>\n<h2>Administratorul de firm\u0103: c\u00e2nd apare riscul real<\/h2>\n<p><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2026\/06\/indemnizatie-crestere-copil-administrator-firma-scaled.jpg\"><img decoding=\"async\" class=\"aligncenter wp-image-10040 lazyload\" --smush-placeholder-aspect-ratio: 750\/500;\" \/><\/a><\/p>\n<p>\u00cen cazul administratorilor de societ\u0103\u021bi comerciale, analiza trebuie f\u0103cut\u0103 \u00een func\u021bie de con\u021binutul mandatului \u0219i de existen\u021ba unei remunera\u021bii.<\/p>\n<p>Exist\u0103 numeroase situa\u021bii \u00een care administratorii exercit\u0103 aceast\u0103 func\u021bie f\u0103r\u0103 s\u0103 \u00eencaseze o indemniza\u021bie sau o remunera\u021bie distinct\u0103.<\/p>\n<p>\u00cen asemenea cazuri, simpla men\u021binere a calit\u0103\u021bii de administrator nu afecteaz\u0103 dreptul la concediu \u0219i indemniza\u021bie pentru cre\u0219terea copilului.<\/p>\n<p>Problema apare atunci c\u00e2nd mandatul este remunerat.<\/p>\n<p>Dac\u0103 administratorul \u00eencaseaz\u0103 venituri pentru activitatea desf\u0103\u0219urat\u0103, acestea intr\u0103 \u00een categoria veniturilor care trebuie analizate din perspectiva plafonului legal.<\/p>\n<p>\u00cen func\u021bie de valoarea acestora \u0219i de natura activit\u0103\u021bii desf\u0103\u0219urate, poate ap\u0103rea riscul suspend\u0103rii indemniza\u021biei.<\/p>\n<h2>Dividendele nu sunt considerate venituri rezultate din activitate efectiv\u0103<\/h2>\n<p>Un aspect care genereaz\u0103 frecvent \u00eengrijor\u0103ri este legat de dividende.<\/p>\n<p>Mul\u021bi asocia\u021bi sau ac\u021bionari care beneficiaz\u0103 de concediu pentru cre\u0219terea copilului se tem c\u0103 distribuirea dividendelor ar putea afecta indemniza\u021bia.<\/p>\n<p>\u00cen realitate, dividendele reprezint\u0103 venituri pasive.<\/p>\n<p>Acestea nu sunt ob\u021binute ca rezultat al unei activit\u0103\u021bi efective desf\u0103\u0219urate \u00een perioada concediului, ci deriv\u0103 din dreptul de proprietate asupra participa\u021biilor de\u021binute \u00een societate.<\/p>\n<p>Din acest motiv, \u00eencasarea dividendelor nu conduce, \u00een sine, la suspendarea indemniza\u021biei.<\/p>\n<p>Aceea\u0219i logic\u0103 se aplic\u0103 \u0219i \u00een cazul altor venituri pasive, precum cele provenite din chirii.<\/p>\n<h2>Nu este necesar\u0103 suspendarea activit\u0103\u021bii firmei<\/h2>\n<p>O alt\u0103 idee gre\u0219it\u0103 \u00eent\u00e2lnit\u0103 frecvent este aceea c\u0103 p\u0103rintele aflat \u00een concediu pentru cre\u0219terea copilului trebuie s\u0103 \u00ee\u0219i suspende activitatea firmei sau s\u0103 renun\u021be la func\u021bia de administrator.<\/p>\n<p>Legisla\u021bia nu impune o astfel de obliga\u021bie.<\/p>\n<p>Faptul c\u0103 o persoan\u0103 este asociat sau administrator al unei societ\u0103\u021bi nu \u00eenseamn\u0103 automat c\u0103 desf\u0103\u0219oar\u0103 o activitate incompatibil\u0103 cu acordarea indemniza\u021biei.<\/p>\n<p>\u00cen practic\u0103, multe firme continu\u0103 s\u0103 func\u021bioneze normal \u00een perioada \u00een care unul dintre asocia\u021bi sau administratori beneficiaz\u0103 de concediu pentru cre\u0219terea copilului.<\/p>\n<p>Ceea ce trebuie monitorizat este nivelul veniturilor ob\u021binute \u0219i natura acestora.<\/p>\n<h2>O precizare important\u0103 din normele de aplicare<\/h2>\n<p>Normele de aplicare ale OUG nr. 111\/2010 con\u021bin o prevedere relevant\u0103 pentru persoanele care au ob\u021binut anterior mai multe tipuri de venituri.<\/p>\n<p>\u00cen situa\u021bia \u00een care dreptul la indemniza\u021bie a fost stabilit pe baza mai multor categorii de venituri, beneficiarul nu este obligat s\u0103 suspende toate activit\u0103\u021bile care au stat la baza acord\u0103rii dreptului.<\/p>\n<p>Este suficient\u0103 suspendarea uneia dintre activit\u0103\u021bile care au generat veniturile luate \u00een calcul la stabilirea indemniza\u021biei, \u00een condi\u021biile prev\u0103zute de lege.<\/p>\n<p>Aceast\u0103 regul\u0103 ofer\u0103 mai mult\u0103 flexibilitate pentru antreprenorii \u0219i administratorii care \u00ee\u0219i organizeaz\u0103 activitatea prin mai multe forme juridice.<\/p>\n<h2>Ce ar trebui s\u0103 verifice departamentele de payroll<\/h2>\n<p>Pentru speciali\u0219tii \u00een salarizare \u0219i administrare de personal, este important\u0103 analiza fiec\u0103rei situa\u021bii individuale.<\/p>\n<p>\u00cen practic\u0103, ar trebui verificate:<\/p>\n<ul>\n<li>natura veniturilor ob\u021binute \u00een perioada concediului;<\/li>\n<li>existen\u021ba unui mandat remunerat de administrator;<\/li>\n<li>valoarea total\u0103 a veniturilor realizate din activit\u0103\u021bi efective;<\/li>\n<li>respectarea plafonului anual de 13.208 lei;<\/li>\n<li>documentele care justific\u0103 natura pasiv\u0103 sau activ\u0103 a veniturilor.<\/li>\n<\/ul>\n<p>O evaluare corect\u0103 poate preveni at\u00e2t suspendarea nejustificat\u0103 a indemniza\u021biei, c\u00e2t \u0219i situa\u021biile \u00een care beneficiarul este obligat ulterior s\u0103 restituie sumele \u00eencasate.<\/p>\n<h2>\u00centreb\u0103ri frecvente<\/h2>\n<p><strong>Pot fi administrator de firm\u0103 \u0219i s\u0103 primesc indemniza\u021bia de cre\u0219tere a copilului?<\/strong><\/p>\n<p>Da. Calitatea de administrator nu conduce automat la suspendarea indemniza\u021biei.<\/p>\n<p><strong>Dac\u0103 primesc dividende, pierd indemniza\u021bia?<\/strong><\/p>\n<p>Nu. Dividendele sunt considerate venituri pasive \u0219i nu afecteaz\u0103, \u00een principiu, dreptul la indemniza\u021bie.<\/p>\n<p><strong>Ce se \u00eent\u00e2mpl\u0103 dac\u0103 mandatul de administrator este remunerat?<\/strong><\/p>\n<p>Veniturile ob\u021binute trebuie analizate din perspectiva plafonului legal aplicabil veniturilor realizate \u00een perioada concediului.<\/p>\n<p><strong>Care este plafonul de venituri permis \u00een 2026?<\/strong><\/p>\n<p>Beneficiarul poate realiza venituri nete de p\u00e2n\u0103 la 13.208 lei anual din activit\u0103\u021bi efective f\u0103r\u0103 a pierde dreptul la indemniza\u021bie.<\/p>\n<h2>Concluzie<\/h2>\n<p>Calitatea de administrator al unei societ\u0103\u021bi comerciale nu este incompatibil\u0103 cu acordarea indemniza\u021biei pentru cre\u0219terea copilului.
