Faptul c\u0103 un act normativ este anulat \u00een prim\u0103 instan\u021b\u0103 nu \u00eenseamn\u0103 automat c\u0103 acesta \u00eenceteaz\u0103 s\u0103 produc\u0103 efecte p\u00e2n\u0103 la solu\u021bionarea definitiv\u0103 a litigiului.<\/p>\n<p>\u00cen lipsa suspend\u0103rii, actul continu\u0103 s\u0103 fie aplicabil.<\/p>\n<h2>De ce nu se schimb\u0103 nimic, deocamdat\u0103, pentru angajatori<\/h2>\n<p>\u00cen practic\u0103, mul\u021bi angajatori tind s\u0103 asocieze o hot\u0103r\u00e2re de anulare cu \u00eencetarea imediat\u0103 a obliga\u021biilor legale.<br \/>\n\u00cen cazul HG nr. 295\/2025, o astfel de abordare ar fi riscant\u0103.<\/p>\n<p>Hot\u0103r\u00e2rea Cur\u021bii de Apel Constan\u021ba nu este definitiv\u0103, iar p\u00e2n\u0103 la epuizarea c\u0103ilor de atac cadrul legal r\u0103m\u00e2ne neschimbat.<\/p>\n<p>Mai mult, chiar dac\u0103 solu\u021bia de anulare va fi men\u021binut\u0103 ulterior de instan\u021ba suprem\u0103, efectele unei asemenea decizii se vor produce numai \u00een condi\u021biile prev\u0103zute de lege \u0219i dup\u0103 parcurgerea etapelor procedurale necesare.<\/p>\n<p>Din perspectiva conform\u0103rii, angajatorii trebuie s\u0103 continue s\u0103 opereze \u00een REGES \u0219i s\u0103 respecte termenele \u0219i obliga\u021biile prev\u0103zute de legisla\u021bia aflat\u0103 \u00een vigoare.<\/p>\n<h2>De ce este important\u0103 motivarea hot\u0103r\u00e2rii<\/h2>\n<p>La momentul redact\u0103rii acestui articol, hot\u0103r\u00e2rea nu este motivat\u0103, iar informa\u021biile disponibile provin exclusiv din minuta publicat\u0103 de instan\u021b\u0103.<\/p>\n<p>Acest aspect este important deoarece motivarea va clarifica motivele pentru care instan\u021ba a considerat c\u0103 HG nr. 295\/2025 este nelegal\u0103.<\/p>\n<p>\u00cen func\u021bie de argumentele re\u021binute de judec\u0103tori, impactul asupra viitorului sistemului REGES poate fi diferit.<\/p>\n<p>De exemplu, dac\u0103 instan\u021ba a identificat probleme de procedur\u0103 sau vicii de tehnic\u0103 legislativ\u0103, acestea ar putea fi remediate printr-o nou\u0103 interven\u021bie normativ\u0103.<\/p>\n<p>Dac\u0103 \u00eens\u0103 motivele de nelegalitate vizeaz\u0103 aspecte esen\u021biale ale reglement\u0103rii, autorit\u0103\u021bile ar putea fi nevoite s\u0103 reg\u00e2ndeasc\u0103 anumite componente ale sistemului.<\/p>\n<p>Pentru speciali\u0219tii \u00een resurse umane \u0219i payroll, motivarea va reprezenta principalul document care va permite evaluarea impactului real al litigiului.<\/p>\n<h2>Ce se \u00eent\u00e2mpl\u0103 dac\u0103 anularea r\u0103m\u00e2ne definitiv\u0103<\/h2>\n<p>O alt\u0103 interpretare gre\u0219it\u0103 care circul\u0103 \u00een practic\u0103 este aceea c\u0103 anularea HG nr. 295\/2025 ar conduce automat la dispari\u021bia obliga\u021biilor privind eviden\u021ba salaria\u021bilor.<\/p>\n<p>\u00cen realitate, obliga\u021bia angajatorilor de a \u021bine eviden\u021ba raporturilor de munc\u0103 nu este creat\u0103 exclusiv de aceast\u0103 hot\u0103r\u00e2re de Guvern.<\/p>\n<p>Temeiul principal se reg\u0103se\u0219te \u00een Codul muncii \u0219i \u00een ansamblul legisla\u021biei privind eviden\u021ba salaria\u021bilor.<\/p>\n<p>Prin urmare, chiar dac\u0103 anularea va deveni definitiv\u0103, angajatorii nu vor fi exonera\u021bi de obliga\u021biile privind \u00eenregistrarea \u0219i eviden\u021ba raporturilor de munc\u0103.<\/p>\n<p>Ceea ce s-ar putea modifica este mecanismul concret de raportare, procedurile aplicabile \u0219i cadrul tehnic utilizat pentru gestionarea registrului.<\/p>\n<h2>Impactul pentru departamentele de HR \u0219i payroll<\/h2>\n<p>Din perspectiv\u0103 opera\u021bional\u0103, cea mai prudent\u0103 abordare este men\u021binerea tuturor procedurilor de conformare aflate \u00een prezent \u00een vigoare.<\/p>\n<p>Departamentele de HR \u0219i administrare de personal ar trebui s\u0103 continue:<\/p>\n<ul>\n<li>operarea modific\u0103rilor \u00een termenele legale;<\/li>\n<li>actualizarea datelor din registru;<\/li>\n<li>respectarea obliga\u021biilor de raportare;<\/li>\n<li>monitorizarea evolu\u021biei litigiului \u0219i a eventualelor modific\u0103ri legislative.<\/li>\n<\/ul>\n<p>\u00cen acest moment, nu exist\u0103 un temei juridic care s\u0103 justifice suspendarea implement\u0103rii procedurilor impuse de HG nr. 295\/2025.<\/p>\n<p>O eventual\u0103 decizie intern\u0103 de ignorare a obliga\u021biilor actuale ar putea expune angajatorul la sanc\u021biuni, \u00een cazul \u00een care cadrul normativ r\u0103m\u00e2ne \u00een vigoare.<\/p>\n<h2>Ce urmeaz\u0103 pentru REGES<\/h2>\n<p>Urm\u0103toarele luni vor fi esen\u021biale pentru clarificarea situa\u021biei juridice.<\/p>\n<p>Exist\u0103 dou\u0103 elemente pe care speciali\u0219tii \u00een payroll \u0219i HR ar trebui s\u0103 le urm\u0103reasc\u0103 atent:<\/p>\n<ul>\n<li>publicarea motiv\u0103rii hot\u0103r\u00e2rii Cur\u021bii de Apel Constan\u021ba;<\/li>\n<li>solu\u021bionarea c\u0103ii de atac \u0219i pronun\u021barea unei hot\u0103r\u00e2ri definitive.<\/li>\n<\/ul>\n<p>Abia dup\u0103 aceste etape va putea fi evaluat impactul real asupra sistemului REGES \u0219i asupra obliga\u021biilor angajatorilor.<\/p>\n<p>P\u00e2n\u0103 atunci, orice concluzie privind dispari\u021bia obliga\u021biilor sau revenirea la reglement\u0103rile anterioare r\u0103m\u00e2ne prematur\u0103.<\/p>\n<h2>\u00centreb\u0103ri frecvente despre REGES 2026<\/h2>\n<p><strong>HG nr. 295\/2025 a fost anulat\u0103. Mai trebuie respectat\u0103?<\/strong><\/p>\n<p>Da. Hot\u0103r\u00e2rea de anulare nu este definitiv\u0103, iar cererea de suspendare a fost respins\u0103. Actul normativ continu\u0103 s\u0103 produc\u0103 efecte.<\/p>\n<p><strong>Pot angajatorii s\u0103 renun\u021be la raport\u0103rile \u00een REGES?<\/strong><\/p>\n<p>Nu. Obliga\u021biile de eviden\u021b\u0103 \u0219i raportare r\u0103m\u00e2n aplicabile p\u00e2n\u0103 la o eventual\u0103 modificare a cadrului legal.<\/p>\n<p><strong>Ce importan\u021b\u0103 are motivarea instan\u021bei?<\/strong><\/p>\n<p>Motivarea va ar\u0103ta care sunt motivele de nelegalitate re\u021binute de judec\u0103tori \u0219i va permite evaluarea impactului real asupra sistemului REGES.<\/p>\n<p><strong>Dac\u0103 anularea r\u0103m\u00e2ne definitiv\u0103, dispare obliga\u021bia de eviden\u021b\u0103 a salaria\u021bilor?<\/strong><\/p>\n<p>Nu.
