Dac\u0103 p\u00e2n\u0103 acum accentul era pus aproape exclusiv pe ob\u021binerea avizelor de munc\u0103 \u0219i a documentelor de \u0219edere, <a href=\"https:\/\/lege5.ro\/Gratuit\/ge4dkmzvgmydq\/ordonanta-de-urgenta-32-2026-titlul-ii-modificarea-si-completarea-ordonantei-de-urgenta-a-guvernului-nr-194-2002-privind-regimul-strainilor-in-romania-republicata-cu-modificarile-si-completarile-ulter?dp=gy3tmmztgiytiny\" target=\"_blank\" rel=\"noopener\"><strong>OUG nr. 32\/2026<\/strong><\/a> schimb\u0103 semnificativ abordarea.<\/p>\n<p>Noua legisla\u021bie introduce platforma WorkinRomania.gov.ro \u0219i creeaz\u0103 dou\u0103 regimuri distincte pentru companiile care doresc s\u0103 recruteze cet\u0103\u021beni str\u0103ini: angajator \u00eenregistrat \u0219i angajator autorizat.<\/p>\n<p>De\u0219i diferen\u021ba pare administrativ\u0103, \u00een realitate aceasta influen\u021beaz\u0103 direct costurile recrut\u0103rii, nivelul de autonomie al companiei \u0219i obliga\u021biile de conformare pe termen lung.<\/p>\n<h2>Ce urm\u0103resc autorit\u0103\u021bile prin noul sistem<\/h2>\n<p>Una dintre concluziile care reiese din noul act normativ este c\u0103 statul nu mai analizeaz\u0103 doar momentul recrut\u0103rii, ci \u00eentregul parcurs al lucr\u0103torului str\u0103in \u00een Rom\u00e2nia.<\/p>\n<p>Autorit\u0103\u021bile urm\u0103resc:<\/p>\n<ul>\n<li>modul \u00een care sunt selecta\u021bi lucr\u0103torii;<\/li>\n<li>legalitatea procedurilor de recrutare;<\/li>\n<li>integrarea acestora dup\u0103 sosirea \u00een Rom\u00e2nia;<\/li>\n<li>respectarea obliga\u021biilor salariale;<\/li>\n<li>men\u021binerea unui statut legal de \u0219edere pe \u00eentreaga perioad\u0103 a contractului.<\/li>\n<\/ul>\n<p>Practic, recrutarea interna\u021bional\u0103 este tratat\u0103 ca un proces continuu de conformare, nu ca o simpl\u0103 formalitate administrativ\u0103.<\/p>\n<h2>Angajatorul \u00eenregistrat \u2013 modelul standard<\/h2>\n<p>Pentru majoritatea companiilor, statutul de angajator \u00eenregistrat va reprezenta op\u021biunea uzual\u0103.<\/p>\n<p>\u00cen aceast\u0103 situa\u021bie, compania este \u00eenregistrat\u0103 \u00een platforma WorkinRomania \u0219i poate recruta lucr\u0103tori str\u0103ini utiliz\u00e2nd mecanismele prev\u0103zute de lege, inclusiv prin intermediul agen\u021biilor autorizate de plasare.<\/p>\n<p>Avantajul principal este c\u0103 nivelul de responsabilitate \u0219i expunerea financiar\u0103 sunt mai reduse.<\/p>\n<p>Compania nu trebuie s\u0103 constituie garan\u021bii financiare pentru fiecare lucr\u0103tor \u0219i nu trebuie s\u0103 demonstreze \u00eendeplinirea unor condi\u021bii suplimentare privind istoricul recrut\u0103rilor sau capacitatea administrativ\u0103.<\/p>\n<p>Pentru organiza\u021biile care recruteaz\u0103 ocazional personal din afara UE, aceasta va fi, cel mai probabil, solu\u021bia cea mai eficient\u0103.<\/p>\n<h2>Angajatorul autorizat \u2013 mai mult control, dar \u0219i mai multe obliga\u021bii<\/h2>\n<p><a href=\"https:\/\/www.lugera.ro\/blog\/wp-content\/uploads\/2026\/06\/oug-32-2026-scaled.jpg\"><img decoding=\"async\" class=\"aligncenter wp-image-10015 lazyload\" a depinde de agen\u021bii de plasare, legisla\u021bia introduce posibilitatea ob\u021binerii statutului de angajator autorizat.<\/p>\n<p>Acest statut ofer\u0103 mai mult\u0103 autonomie, \u00eens\u0103 vine la pachet cu obliga\u021bii suplimentare \u0219i condi\u021bii de acces considerabil mai stricte.<\/p>\n<p>Printre cerin\u021bele prev\u0103zute de OUG nr. 32\/2026 se reg\u0103sesc:<\/p>\n<ul>\n<li>desf\u0103\u0219urarea unei activit\u0103\u021bi economice continue de minimum 24 de luni;<\/li>\n<li>existen\u021ba a cel pu\u021bin 50 de salaria\u021bi;<\/li>\n<li>\u00eenregistrarea \u00een platforma WorkinRomania;<\/li>\n<li>constituirea unei garan\u021bii financiare;<\/li>\n<li>\u00eendeplinirea unor criterii privind istoricul gestion\u0103rii lucr\u0103torilor str\u0103ini.<\/li>\n<\/ul>\n<p>Prin aceste condi\u021bii, legiuitorul transmite un mesaj clar: recrutarea direct\u0103 a lucr\u0103torilor str\u0103ini este rezervat\u0103 companiilor care pot demonstra stabilitate \u0219i capacitate administrativ\u0103.<\/p>\n<h2>Garan\u021bia financiar\u0103: costul ascuns al autoriz\u0103rii<\/h2>\n<p>Cea mai vizibil\u0103 diferen\u021b\u0103 dintre cele dou\u0103 regimuri este obliga\u021bia constituirii unei garan\u021bii financiare.<\/p>\n<p>Pentru angajatorii autoriza\u021bi, cuantumul acesteia este de:<br \/>\n<strong>1.000 euro pentru fiecare lucr\u0103tor str\u0103in pentru care se solicit\u0103 autorizarea.<\/strong><\/p>\n<p>Aceast\u0103 sum\u0103 nu reprezint\u0103 un cost salarial \u0219i nu genereaz\u0103 obliga\u021bii fiscale, \u00eens\u0103 afecteaz\u0103 direct lichiditatea companiei.<\/p>\n<p>Exemplele sunt relevante:<br \/>\n10 lucr\u0103tori str\u0103ini = garan\u021bie de 10.000 euro;<br \/>\n25 lucr\u0103tori str\u0103ini = garan\u021bie de 25.000 euro;<br \/>\n50 lucr\u0103tori str\u0103ini = garan\u021bie de 50.000 euro;<br \/>\n100 lucr\u0103tori str\u0103ini = garan\u021bie de 100.000 euro.<\/p>\n<p>\u00cen practic\u0103, pentru multe organiza\u021bii, aceast\u0103 cerin\u021b\u0103 poate fi mai important\u0103 dec\u00e2t costul efectiv al procedurilor administrative.<\/p>\n<h2>Istoricul companiei devine criteriu de eligibilitate<\/h2>\n<p>Una dintre cele mai interesante nout\u0103\u021bi ale OUG nr. 32\/2026 este faptul c\u0103 autorizarea nu depinde doar de situa\u021bia actual\u0103 a companiei.<\/p>\n<p>Dac\u0103 angajatorul a avut lucr\u0103tori str\u0103ini \u00een anul anterior solicit\u0103rii autoriz\u0103rii, legisla\u021bia verific\u0103 \u0219i modul \u00een care ace\u0219tia au fost gestiona\u021bi.<\/p>\n<p>Mai exact, procentul lucr\u0103torilor care nu mai de\u021bin un drept de \u0219edere valabil sau o viz\u0103 valabil\u0103, \u00een situa\u021biile prev\u0103zute de legisla\u021bia privind regimul str\u0103inilor, nu poate dep\u0103\u0219i 20% din totalul lucr\u0103torilor str\u0103ini angaja\u021bi \u00een perioada analizat\u0103.<\/p>\n<p>Aceast\u0103 condi\u021bie schimb\u0103 fundamental abordarea autorit\u0103\u021bilor.<\/p>\n<p>Pentru prima dat\u0103, istoricul de conformare al companiei devine un criteriu explicit de acces la recrutarea interna\u021bional\u0103.<\/p>\n<h2>Lista ocupa\u021biilor deficitare: un filtru suplimentar<\/h2>\n<p>Statutul de angajator autorizat nu ofer\u0103 libertate nelimitat\u0103 \u00een recrutare.<\/p>\n<p>OUG nr. 32\/2026 introduce \u0219i conceptul listei ocupa\u021biilor deficitare, care va fi actualizat\u0103 periodic de autorit\u0103\u021bi.<\/p>\n<p>\u00cen practic\u0103, acest lucru \u00eenseamn\u0103 c\u0103 angajatorii trebuie s\u0103 \u00ee\u0219i coreleze strategiile de recrutare cu ocupa\u021biile pentru care statul recunoa\u0219te existen\u021ba unui deficit real de for\u021b\u0103 de munc\u0103.<\/p>\n<p>Pentru departamentele de HR, aceast\u0103 schimbare poate avea un impact direct asupra planific\u0103rii recrut\u0103rilor viitoare.<\/p>\n<h2>Impactul pentru payroll \u0219i administrarea de personal<\/h2>\n<p>De\u0219i statutul de angajator autorizat este analizat, de regul\u0103, din perspectiva recrut\u0103rii, efectele sale se extind \u0219i asupra activit\u0103\u021bilor de payroll \u0219i administrare de personal.<\/p>\n<p>Companiile trebuie s\u0103 gestioneze direct:<\/p>\n<ul>\n<li>monitorizarea documentelor de \u0219edere;<\/li>\n<li>p\u0103strarea eviden\u021belor justificative;<\/li>\n<li>obliga\u021biile de raportare c\u0103tre autorit\u0103\u021bi;<\/li>\n<li>respectarea condi\u021biilor care au stat la baza autoriz\u0103rii;<\/li>\n<li>plata salariilor lucr\u0103torilor str\u0103ini prin cont bancar, conform noilor prevederi introduse de OUG nr. 32\/2026.<\/li>\n<\/ul>\n<p>\u00cen acest context, recrutarea interna\u021bional\u0103 devine tot mai mult o problem\u0103 de conformare \u0219i management al riscului, nu doar o solu\u021bie pentru acoperirea deficitului de personal.<\/p>\n<h2>Merit\u0103 s\u0103 devii angajator autorizat?<\/h2>\n<p>R\u0103spunsul depinde \u00een mare m\u0103sur\u0103 de volumul recrut\u0103rilor \u0219i de resursele interne disponibile.<\/p>\n<p>Pentru companiile care recruteaz\u0103 sporadic lucr\u0103tori str\u0103ini, statutul de angajator \u00eenregistrat va fi, \u00een majoritatea cazurilor, suficient.<\/p>\n<p>\u00cen schimb, pentru organiza\u021biile care recruteaz\u0103 constant zeci sau sute de persoane din afara Uniunii Europene, autorizarea poate oferi un grad mai mare de control \u0219i independen\u021b\u0103 opera\u021bional\u0103.<\/p>\n<p>Totu\u0219i, aceast\u0103 autonomie trebuie analizat\u0103 \u00eempreun\u0103 cu costurile generate de garan\u021biile financiare, obliga\u021biile suplimentare de conformare \u0219i riscurile asociate gestion\u0103rii directe a \u00eentregului proces.<\/p>\n<h2>Concluzie<\/h2>\n<p>Prin OUG nr. 32\/2026, recrutarea lucr\u0103torilor str\u0103ini intr\u0103 \u00eentr-o nou\u0103 etap\u0103.
